Amor Mundi 2/24/13
Hannah Arendt considered calling her magnum opus Amor Mundi: Love of the World. Instead, she settled upon The Human Condition. What is most difficult, Arendt writes, is to love the world as it is, with all the evil and suffering in it. And yet she came to do just that. Loving the world means neither uncritical acceptance nor contemptuous rejection. Above all it means the unwavering facing up to and comprehension of that which is.

Clocking in as the longest article ever in Time (h/t Dylan Byers), Steven Brill’s cover story is the single-best account of the insanity and corruption of our current medical system. Why do we accept the skyrocketing costs of medical care? “Those who work in the health care industry and those who argue over health care policy seem inured to the shock.” Brill shows us why the bills are really way too high. Hint: it is not because the care is so good. There are so many excess costs in the system, that reforming it should be easy, if it weren’t so corrupt.
David Goldhill wants to give all working Americans $1,800,000, the amount he calculates a 23 year-old beginning work today at $35,000/year will pay, directly or indirectly, in health care insurance benefits. Goldhill argues that our health care system wastes most of that money because people have no incentive to attend to costs. He suggests a dual system. Give every American health insurance for truly rare and unpredictable illnesses. But for regular costs and smaller emergencies, he would refund workers the money they are losing and let them pay for healthcare themselves.
Oliver Sacks walks through his past and, with the help of his brother, discovers that a memory he had believed his own had actually been that of another. Starting from there, he gives a short account of the weakness of individual remembering, which allows us to take in something we've heard or seen and make it our own. He concludes, finally, that "memory is dialogic and arises not only from direct experience but from the intercourse of many minds."
The Subtlety of the Dole for the Rich
Michael Lewis writes of the rise of an unapologetic business class in the 1990s and early 2000’s, that they enjoyed the “upside to big risk-taking, the costs of which would be socialized, if they ever went wrong. For a long time they looked simply like fair compensation for being clever and working hard. But that’s not what they really were; and the net effect was… to get rid of the dole for the poor and replace it with a far more generous, and far more subtle, dole for the rich.”
Five women. “Two are wives and daughters in ordinary families unable to comprehend why such misfortune has overtaken them. A third is a young bride living in the household of a high party official. The last two are wives of the Master’s executioners. These stories are based on their memoirs—some written by themselves, others by close friends or by their children. These five women put a human face on the terror of Stalin’s purges and the Gulag in the Soviet Union of the 1930s.”
“Debt doesn’t look like much. It has no shape or smell. But, over time, it leaves a mark. In Spain, it manifested itself, first, as empty buildings, stillborn projects, and idled machines.” So writes Nick Paumgarten. To see how debt looks and smells, look at Simon Norfolk's surreal photographs of Residencial Francisco Hernando, an unfinished development near Seseña, Spain. Working his way through a half-finished city with few people in it, Norfolk's photography suggests that even beginning construction was an act of hubris; "everyone," he says, "wanted to get rich doing nothing."
The Arendt Center’s 2012 conference “Does the President Matter?” asked whether political leadership is still possible today. Guatam Mukunda believes that we can measure the value of a particular leader based on their behavior at the margins—what did that person accomplish over and above what another would have been able to do? In the accompanying video, Mukunda argues that leaders can only be great or terrible when the people selected for such roles are relatively unknown to those making the selection. In an age of information, the chances are slim.

This week on the blog, we argued that American reformers should shift their efforts at reforming education towards high school and pointed towards Richard Kahlenberg's recent piece in The Chronicle of Higher Education, adding that "poverty, more than race or gender, is increasingly the true mark of disadvantage in 21st century America." We also continued the inquiry into the growing threat that entitlements pose to the next generation, highlighting Geoffrey Canada and Peter Druckenmiller's argument that entitlements are a generational theft that must be arrested. Reflections on an Inaugural Address
I watched President Obama’s second Inaugural Address with my seven-year-old daughter. She had just completed a letter to the President—something she had been composing all week. She was glued to the TV. I found myself tearing up at times, as I do and should do at all such events. “The Star Spangled Banner” by Beyonce was… well, my daughter stood up right there in the living room, so I followed suit. The Inaugural Poem by Richard Blanco began strong—I found the first two stanzas powerful and lyrical.
The invocation of “One sun rose on us today,” is Whitmanesque, as is: “My face, your face, millions of faces in morning’s mirrors.” That second verse really grabbed me:
My face, your face, millions of faces in morning’s mirrors,
each one yearning to life, crescendoing into our day,
pencil-yellow school buses, the rhythm of traffic lights,
fruit stands: apples, limes, and oranges arrayed like rainbows
begging our praise. Silver trucks heavy with oil or paper—
bricks or milk, teeming over highways alongside us,
on our way to clean tables, read ledgers, or save lives—
to teach geometry, or ring-up groceries as my mother did
for twenty years, so I could write this poem.
I was hooked here, with Blanco’s rendition of a motley American life guided by a rising sun. But the poem dragged for me. I lost the thread. Still, I am so grateful for the continued presence of poetry at inaugural events. They remind us that the Presidency and the country is more than policy and prose.
In the President’s speech itself, there was too much politics, some prose, and a bit of poetry. There were a few stirring lines affirming the grand dreams of the United States. His opening was pitch perfect:
Each time we gather to inaugurate a President we bear witness to the enduring strength of our Constitution. We affirm the promise of our democracy. We recall that what binds this nation together is not the colors of our skin or the tenets of our faith or the origins of our names. What makes us exceptional -- what makes us American -- is our allegiance to an idea articulated in a declaration made more than two centuries ago:
“We hold these truths to be self-evident, that all men are created equal; that they are endowed by their Creator with certain unalienable rights; that among these are life, liberty, and the pursuit of happiness.”
Storytelling, Hannah Arendt knew, was at the essence of politics. The President understands the importance and power of a story and the story of America is one of the dream of democracy and freedom. He tells it well. Some will balk at his full embrace of American exceptionalism. They are right to when such a stand leads to arrogance. But American exceptionalism is also, and more importantly, a tale of the dream of the Promised Land. It is an ever-receding dream, as all such dreams are. But that means only that the dream must be kept alive. That is one of the purposes of Presidential Inaugurations, and President Obama did that beautifully.
Another stirring section invoked the freedom struggles of the past struggles for equality.
We, the people, declare today that the most evident of truths –- that all of us are created equal –- is the star that guides us still; just as it guided our forebears through Seneca Falls, and Selma, and Stonewall; just as it guided all those men and women, sung and unsung, who left footprints along this great Mall, to hear a preacher say that we cannot walk alone; to hear a King proclaim that our individual freedom is inextricably bound to the freedom of every soul on Earth.
The President, our nation’s first black President now elected for a second term, sought to raise the aspiration for racial and sexual equality to the pantheon of our Constitutional truths. Including the struggles of gay Americans—he mentioned gay rights for the first time in an inaugural address—the President powerfully rooted the inclusivity of the American dream in the sacred words of the Declaration of Independence and set them in the hallowed grounds of constitutional ideals.
When later I saw the headlines and the blogs, it was as if I had watched a different speech. Supposedly the President offered an “aggressive” speech. And he came out as unabashedly liberal. This is because he mentioned climate change (saying nothing about how he will approach it) and gay rights. Oh, and many saw it as unabashedly liberal when the President said:
For we, the people, understand that our country cannot succeed when a shrinking few do very well and a growing many barely make it. We believe that America’s prosperity must rest upon the broad shoulders of a rising middle class. We know that America thrives when every person can find independence and pride in their work; when the wages of honest labor liberate families from the brink of hardship. We are true to our creed when a little girl born into the bleakest poverty knows that she has the same chance to succeed as anybody else, because she is an American; she is free, and she is equal, not just in the eyes of God but also in our own.
How is it “liberal” to value the middle-class and pride in work? There was nearly nothing in this talk about the poor or welfare. It was about working Americans, the people whose labor builds the bridges and protects are people. And it was about the American dream of income and class mobility. How is that liberal? Is it liberal to insist on a progressive income tax? Granted, it is liberal to insist that we raise revenue without cutting expenses. But where was that said?
And then there are the swarm of comments and critiques about the President’s defense of entitlements. Well here is what he said:
We understand that outworn programs are inadequate to the needs of our time. So we must harness new ideas and technology to remake our government, revamp our tax code, reform our schools, and empower our citizens with the skills they need to work harder, learn more, reach higher. But while the means will change, our purpose endures: a nation that rewards the effort and determination of every single American. That is what this moment requires. That is what will give real meaning to our creed. We, the people, still believe that every citizen deserves a basic measure of security and dignity. We must make the hard choices to reduce the cost of health care and the size of our deficit. But we reject the belief that America must choose between caring for the generation that built this country and investing in the generation that will build its future. (Applause.) For we remember the lessons of our past, when twilight years were spent in poverty and parents of a child with a disability had nowhere to turn.
If I read this correctly, the President is here saying: We spend too much on health care and we need to cut our deficit. Outworn programs must change and we need innovation and technology to improve our schools even as we reduce the cost of education. We must, he says, “make the hard choices to reduce the cost of health care and the size of our deficit.” Yet we must do so without abandoning the nation’s creed: the every American has equal worth and dignity. This is a call for changing and rethinking entitlements while cutting their cost. It is pragmatic and yet sensible. How is it liberal? Is it now liberal to believe in social security and Medicare? Show me any nationally influential conservative who will do away with these programs? Reform them, yes. But abandon them?
More than a liberal, the President sounded like a constitutional law professor. He laid out broad principles. We must care for our fellow citizens. But he left open the way that we might do so.
Perhaps the most problematic section of the President’s speech is this one:
We do not believe that in this country freedom is reserved for the lucky, or happiness for the few. We recognize that no matter how responsibly we live our lives, any one of us at any time may face a job loss, or a sudden illness, or a home swept away in a terrible storm. The commitments we make to each other through Medicare and Medicaid and Social Security, these things do not sap our initiative, they strengthen us. They do not make us a nation of takers; they free us to take the risks that make this country great.
Here the President might sound liberal. But what is he saying? He is raising the entitlement programs of the New Deal to Constitutional status, saying that these programs are part of the American way of life. He is not wrong. No Republican—not Reagan, not Romney, not Paul Ryan—proposes getting rid of these programs. They have become part of the American way of life.
That said, these programs are not unproblematic. The President might say that “these things do not sap our initiative, they strengthen us. They do not make us a nation of takers; they free us to take the risks that make this country great.” But saying it does not make it true. There are times when these programs care for the sick and unfortunate. And yet there are no doubt times and places where the social safety net leads to taking and weakness. It is also true that these programs are taking up ever more of our national budget, as this chart from the Government Accounting Office makes clear.
The President knows we need to cut entitlements. He has said so repeatedly. His greatest liability now is not that he can’t control opposition Republicans. It is that he doesn’t seem able or willing to exert leadership over the members of his own party in coming up with a meaningful approach to bring our entitlement spending—spending that is necessary and rightly part of our constitutional DNA—into the modern era. That is the President’s challenge.
The problem with President Obama’s speech was not that it was liberal. Rather, what the President failed to offer was a meaningful example of leadership in doing what he knows we must do: Rethinking, re-imagining, and re-forming our entitlement programs to bring them into the modern era.

Infinitely Intoxicating
Louis Pasteur once wrote:
I see everywhere in the world, the inevitable expression of the concept of infinity…. The idea of God is nothing more than one form of the idea of infinity. So long as the mystery of the infinite weighs on the human mind, so long will temples be raised to the cult of the infinite, whether it be called Bramah, Allah, Jehovah, or Jesus…. The Greeks understood the mysterious power of the hidden side of things. They bequethed to us one of the most beautiful words in our language—the word ‘enthusiasm’—En Theos—“A God Within.” The grandeur of human actions is measured by the inspiration from which they spring. Happy is he who hears a god within, and who obeys it. The ideals of art, of science, are lighted by reflection from the infinite.
To bear a god within is not an easy task for us mortals. The god within—even more so than the god without—demands to be obeyed. Having a god inside us—or Socrates like a daimon on our shoulder—is no recipe for happiness.
It can lead to unbearable obligation and even to martyrdom. And, if the god is a muse, it can lead to the travails of the artist.
All great art and all great artists are consumed by the infinite. As Oscar Wilde once wrote, “We are all in the gutter, but some of us are looking up at the stars.” Those are the artists, the ones who amidst the muck feel part of something higher, something everlasting, the infinite.
The great enemy of the infinite is reason. Reason is calculating. It is rational. It is logical. It insists that everything is knowable and comprehensible. Ends justify means. And means can achieve ends. Reason insists on explanation. The self—the mystery—must be made knowable.
David Brooks in the NY Times today lauds the entry of behavioral psychology into politics and policy. We want to know, he writes, how to get people to vote and how to get congress to cut the deficit. If science can tell us how what to put in their drinking water, how to frame the question, what books to read to them in vitro, or how to rewire their brains to be rational, wouldn’t that make policy all the more reasonable? Wouldn’t that be a good thing?
Science can make us more rational. That of course is the dream of people like Ray Kurzweil as well as the social scientists who insist that humans can be studied like rats. Let’s not object to the fact. We can be studied like rats and that is what university social science departments around the country and the world are doing everyday. This research is eminently useful, as Brooks rightly remarks. If we employ it, we can be made to be more reasonable.
What the rationalization of humanity means, however, is not a question science can answer. Max Weber began the study of the rationalization of mankind when he proposed that the rise of the enlightenment and the age of reason was bringing about an “Entzauberung” or a “de-magicification” of the world. Capitalism emerged at this time for a number of reasons, but one main reason, Weber understood, was that capitalism provided in the profit motive rational and objective criteria for measuring human endeavors. The problem, as Weber so well understood, is that the elevation of reason and rationality brought about the devaluation of all highest values—what Nietzsche would call nihilism. This is because reason, derived from ratio, is always a relation. All values are relative. In such a world, nothing is infinite. Stuck amidst the relations of means and ends, everything is a calculation. All is a game. There is no purpose or meaning to the game of life. As we become more rational, we also become less consumed by the infinite. That is the true danger of the rise of the social sciences and our rationality-consumed culture that insists that all human behavior be made understandable so that it can be made better.
In The Human Condition, Hannah Arendt is concerned with the way that the rise of reason and rationality is challenging the quintessence of the human condition—at least as that human condition has been experienced and known since the dawn of humanity. The rise of the social sciences, she writes over and over, are subjecting the mystery and fecundity of human action to the law of large numbers. While each and every human action may in itself be surprising and mysterious, it is nevertheless true that studied in groups and analyzed over time, human action does fall into comprehensible patterns. The more we study and know these patterns, the more we come to think of humans as predictable animals rather than surprising and spontaneous selves. This sociological and psychological reduction of man to animal is very much at the heart of what Arendt is opposing in her book.
Nowhere is the rationality of our times more visible than in the victory of labor and the marginalization of art. We are, all of us, laborers today. That is why the first question we ask others we meet is: What do you do? Our labor defines us. It gives our lives meaning in that it assigns us a use and a value. Even professors, judges, and presidents now say regularly: this is my job. By which we mean, don’t blame us for what we do. Don’t hold me to some higher standard. Don’t expect miracles. It is our job to do this. We do this to make a living.
The one group in society who is at times excepted from this reduction to labor is artists. But even the artist is today is taken less and less seriously. Insofar as artists are enthusiasts consumed with the infinite, they are ignored or viewed as marginal. Art is reduced to playfulness. A hobby. “From the standpoint of “making a living,” every activity unconnected with labor becomes a “hobby.”” And those artists who are taken seriously, whose work is bought and sold on the art market, turn artistic work into the job of making a living.
Art, Arendt writes, is a process of magic. Citing a poem by Rainer Maria Rilke, she insists that the magic of art is the artist’s transfiguration of something ordinary—the canvas, clay or word—into something extraordinary, an expression of the infinite in the finite world of things.
Because art figures the infinite, poetry is the “most human” of the arts and the art that “remains closest to the thought that inspired it.” The poem, of all artworks, is the most lasting because its medium is the least subject to decay. It is the closest expression of the infinite we humans possess.
Ralph Waldo Emerson, whose resonance with Arendt in so many things has been too infrequently remarked, agrees that poetry is the art form in which the individual artist can access and figure in the world a public and common truth. In “The Poet,” Emerson writes:
It is a secret which every intellectual man quickly learns, that beyond the energy of his possessed and conscious intellect, he is capable of a new energy (as of an intellect doubled on itself ), by abandonment to the nature of things; that, beside his privacy of power as an individual man, there is a great public power on which he can draw by unlocking, at all risks, his human doors and suffering the ethereal tides to roll and circulate through him: then he is caught up into the life of the universe; his speech is thunder; his thought is law, and his words are universally intelligible as the plants and animals. The poet knows that he speaks adequately, then, only when he speaks somewhat wildly, or, “with the flower of the mind”; not with the intellect used as an organ but with the intellect released from all service…inebriated by nectar. As the traveler who has lost his way throws his reins on his horse’s neck and trusts to the instinct of the animal to find his road, so must we do with the divine animal who carries us through this world. For if in any manner we can stimulate this instinct, new passages are opened for us into nature, the mind flows into and through things hardest and highest, and the metamorphosis is possible. This is the reason why bards love wine, mead, narcotics, coffee, tea, opium, the fumes of sandalwood and tobacco, or whatever other species of animal exhilaration. All men avail themselves of such means as they can to add this extraordinary power to their normal powers, and to this end they prize conversation, music, pictures, sculpture, dancing, theaters, traveling, wars, mobs, fires, gaming, politics, or love, or science, or animal intoxication, which are several coarser or finer quasi-mechanical substitutes for the true nectar, which is the ravishment of the intellect by coming nearer to the fact.
I take this quotation from Emerson’s “The Poet” from an exceptional recent essay by Sven Birkirts. The essay appears in the latest edition of Lapham’s Quarterly, an entire issue focusing on the merits and need for inebriation.
As Birkirts writes:
For Emerson, the intoxication is not escape but access, a means of getting closer to “the fact,” which might, with heartfelt imprecision, be called life itself. What he means by “public power,” I think, is something like what Carl Jung and others later meant by the phrase collective unconscious, the emphasis falling on the unconscious, that posited reservoir of our shared archetypes and primordial associations—that which reason by itself cannot fathom, for it is, in essence, antithetical to reason.
Birkirt’s reflects not only on the need for inebriation in the pursuit of artistic infinity, but also on the decreasing potency of intoxicants today. For him, the rise of the mass market in art, the globalization of experience, the accessibility of all information all have made the world smaller, knowable, and accountable. What is lost in such access is precisely the portal to the infinite.
Artistically and in almost every other way ours has become a culture of proliferation. Information, perspectives, as well as the hypercharged clips and images of our global experience are within the radius of the keystroke. Nothing is unspoken, nothing is unaccounted. Every taste is given a niche and every niche is catered to. Here, one might argue, is more material than ever; here are opportunities for even greater acts of synthesis. But I am skeptical. Nietzsche wrote in Thus Spoke Zarathustra, “Nothing is true, everything is permitted.” The temptation is to invert the phrases and ascribe causality: where everything is permitted, nothing is true. Where nothing is true, where is the Emersonian fact to be found? This bears directly on the artist’s task. The idea that writers can keep producing grandly synthesizing or totalizing work—that has the ring of truth, of mattering—is debatable.

Asking—and Answering—the Question: Does the President Matter?
The Arendt Center recently completed its fifth annual conference, which revolved this year around the past and present state of the U.S. presidency. I attended most of the proceedings, and the presentations and discussions I witnessed were worthy of close attention. Perhaps above all, the conference sharpened my awareness for the prerogatives, possibilities, and limits that currently define the office of the President.
On the one hand, I now have a better appreciation for the ways that recent Presidents are even more powerful than they were in the past. For instance, they have taken on budgetary and policymaking responsibilities that Congress has effectively abdicated over the past several decades. And, particularly in the wake of the 9/11 attacks, Presidential administrations have accumulated powers of surveillance, arrest, detention, extrajudicial execution, and war-making that circumvent public accountability—not to mention institutional checks and balances—in troubling ways.
On the other hand, recent Presidents face social and political circumstances that constrain their room for maneuver. In the narrow realm of governmental procedure, the frequent recourse to the filibuster and other forms of obstruction in Congress has curtailed President Obama’s power to promote legislation and fill judicial, diplomatic and other appointments. (As a result, he has increasingly turned to executive orders that, at least in certain realms of governance, bypass the House and Senate altogether.)
In the realm of public discourse, recent Presidents contend with a media and consulting culture that inhibits their ability—and perhaps even their desire—to engage the citizenry in informed debate. And in the realm of epistemology, recent Presidents face a confluence of events which do not merely stretch their personal and institutional capacities, but challenge the very terms by which we understand the world. The current state of the Presidency, in other words, is but one part of a larger problem of knowing and thinking in the present.
The conference’s panels and presenters did an admirable job examining these themes, and I do not mean that as faint or empty praise. Yet I was still struck by how resolutely “American” much of the conference was, and not simply because most of the panels dealt in one way or another with the Presidency and the wider U.S. political landscape. To some degree, this focus was only to be expected given the conference’s stated concern with “the American age of political disrepair” and its overlap with the presidential campaign. To my mind, however, the accumulated observations and arguments ultimately betrayed a form of what social scientists would call “methodological nationalism.” That is to say, much of the conference took it for granted that the U.S. nation-state was the appropriate frame of reference for collective reflection on the Presidency, even when the contexts and effects of recent Presidents’ actions reach well beyond this country’s borders.
The guiding question of the conference takes on a somewhat different light when we attempt to think beyond the bounds of the U.S. Indeed, when viewed from a planetary perspective, “does the President matter?” is not so much a provocative query as a curious, even peculiar one. Whenever global deliberations turn to issues like the Arab Spring, the prospect of a nuclear Iran, China’s growing economic might or the consequences of global material disparities, billions of people still regard the U.S. President as the most prominent representative of the world’s most prominent geopolitical power (all invocations of a “decentered” or “multipolar” world notwithstanding). Thus, despite the innumerable perplexities of their office, recent Presidents continue to claim, and continue to be granted, a disproportionate influence in the arena of political speech and action. For many if not most of the world’s residents, the reality of their significance seems so obvious that the weekend’s leitmotiv would not, I suspect, make much sense. Does the President matter? Of course! What is there to argue about here?
I do not, however, want to suggest that this guiding question is utterly baseless. It is in fact closely tied to Americans’ particular—and particularly pointed—anxieties about the accountability, trustworthiness, and effectiveness of their political leadership. Yet the existence of such anxieties should not, I think, imply in and of itself that the powers of the Presidency have been rendered irrelevant. After all, most if not all of the conference presenters ultimately affirmed that the President mattered, even as many of them deplored the current condition of public discourse and civic engagement in the U.S. Moreover, patterns of voter participation in Canada, Latin America, Europe, Japan, India and other parts of the world suggest (however crudely) that many of the world’s other democratic citizens have not reached the depths of apathy and cynicism that characterize the U.S. electorate. This is the case even if they too express distrust of the political figures who profess to govern and lead.
In the end, then, this year’s conference challenged me to consider the state of American and planetary politics with a more acute sense of the potentials, pitfalls, and stakes. Such an outcome is hardly the “miracle” that Arendt instructed us to expect in “What is Freedom?” But it at least offers a foundation for examining—and bearing consciously—some of those burdens which our new century has placed upon us.

Does the President Matter?

And the more heavily the scales are weighted in favor of disaster, the more miraculous will the deed done in freedom appear.”

This week at Bard College, in preparation for the Hannah Arendt Center Conference "Does the President Matter?", we put up 2 writing blocks around campus, multi-paneled chalkboards that invite students to respond to the question: Does the President Matter? The blocks generated quite a few interesting comments. Many mentioned the Supreme Court. Quite a few invoked the previous president, war, and torture. And, since we are at Bard, others responded: it depends what you mean by matters.
This last comment struck me as prescient. It does depend on what you mean by matters.
If what we mean is, say, an increasing and unprecedented power by a democratic leader not seen since the time of enlightened monarchy, the president does matter. We live in an age of an imperial presidency. The President can, at least he does, send our troops into battle without the approval of Congress. The President can, and does, harness the power of the TV, Internet, and twitter to bypass his critics and reach the masses more directly than ever before. The president can, and does, appoint Supreme Court Justices with barely a whimper from the Senate; and the president’s appointments can, and do, swing the balance on a prisoner’s right to habeas corpus, a woman’s right to choose, or a couple’s right to marry.
And yet, what if by matter, we mean something else? What if we mean, having the power to change who we are in meaningful ways? What if by matter we mean: to confront honestly the enormous challenges of the present? What if by matter we mean: to make unpredictable and visionary choices, to invite and inspire a better future?
On the really big questions—the thoughtless consumerism that degrades our environment and our souls; the millions of people who have no jobs and increasingly little prospect for productive employment; the threat of devastating terrorism; and the astronomical National Debt: 16 trillion and counting for the US. -- That is $140,000 for each taxpayer. -- Add to that the deficiency in Public Pension Obligations (estimated at anywhere from $1 to $5 trillion.) Not to mention the 1 trillion dollars of inextinguishable student debt that is creating a lost generation of young people whose lives are stifled by unwise decisions made before they were allowed to buy a beer.
This election should be about a frank acknowledgement of the unsustainability of our economic, social, and environmental practices and expectations. We should be talking together about how we should remake our future in ways that are both just and exciting. This election should be scary and exciting. But so far it’s small-minded and ugly.
Around the world, we witness worldwide distrust and disdain for government. In Greece there is a clear choice between austerity and devaluation; but Greek leaders have saddled their people with half-hearted austerity that causes pain without prospect for relief. In Italy, the paralysis of political leaders has led to resignation and the appointment of an interim technocratic government. In Germany, the most powerful European leader delays and denies, trusting that others will blink every time they are brought to the mouth of the abyss.
No wonder that the Tea Party and Occupy Wall Street in the US, and the Pirate Parties in Europe share a common sense that liberal democratic government is broken. A substantial—and highly educated—portion of the electorate has concluded that our government is so inept and so compromised that it needs to be abandoned or radically constrained. No president, it seems, is up to the challenge of fixing our broken political system.
Every President comes to Washington promising reform! And they all fail. According to Jon Rauch, a leading journalist for The Atlantic and the National Journal, this is inevitable. He has this to say in his book Government's End:
If the business of America is business, the business of government programs and their clients is to stay in business. And after a while, as the programs and the clients and their political protectors adapt to nourish and protect each other, government and its universe of groups reach a turning point—or, perhaps more accurately, a point from which there is no turning back. That point has arrived. Government has become what it is and will remain: a large, incoherent, often incomprehensible mass that is solicitous of its clients but impervious to any broad, coherent program of reform. And this evolution cannot be reversed.
On the really big questions of transforming politics, the President is, Rauch argues, simply powerless. President Obama apparently agrees. Just last week he said, in Florida: "The most important lesson I've learned is that you can't change Washington from the inside. You can only change it from the outside."
A similar sentiment is offered by Laurence Lessig, a founding member of Creative Commons. In his recent book Republic 2.0, Lessig writes:
The great threat today is in plain sight. It is the economy of influence now transparent to all, which has normalized a process that draws our democracy away from the will of the people. A process that distorts our democracy from ends sought by both the Left and the Right: For the single most salient feature of the government that we have evolved is not that it discriminates in favor of one side and against the other. The single most salient feature is that it discriminates against all sides to favor itself. We have created an engine of influence that seeks not some particular strand of political or economic ideology, whether Marx or Hayek. We have created instead an engine of influence that seeks simply to make those most connected rich.
The system of influence and corruption through PACs, SuperPacs, and lobbyists is so entrenched, Lessig writes, that no reform seems plausible. All that is left is the Hail Mary idea of a new constitutional convention—an idea Lessig promotes widely, as with his Conference On the Constitutional Convention last year at Harvard.
For Rauch on the Right and Lessig on the Left, government is so concerned with its parochial interests and its need to stay in business that we have forfeited control over it. We have, in other words, lost the freedom to govern ourselves.
The question "Does the President Matter?" is asked, in the context of the Arendt Center conference, from out of Hannah Arendt's maxim that Freedom is the fundamental raison d'etre of politics. In "What is Freedom?", Arendt writes:
“Freedom is actually the reason that men live together in political organization at all. Without it, political life as such would be meaningless. The raison d’être of politics is freedom.”
So what is freedom? To be free, Arendt says, is to act. Arendt writes: "Men are free as long as they act, neither before nor after; for to be free and to act are the same.”
What is action? Action is something done spontaneously. It brings something new into the world. Man is the being capable of starting something new. Political action, and action in general, must happen in public. Like the performing arts—dance, theatre, and music—politics and political actions requires an audience. Political actors act in front of other people. They need spectators, so that the spectators can be drawn to the action; and when the spectators find the doings of politicians right, or true, or beautiful, they gather around and form themselves into a polity. The political act, the free act must be surprising if it is to draw people to itself. Only an act that is surprising and bold is a political act, because only such an act will strike others, and make them pay attention.
The very word politics derives from the Greek polis which itself is rooted in the Greek pelein, a verb used to describe the circular motion of smoke rings rising up from out of a pipe. The point is that politics is the gathering of a plurality around a common center. The plurality does not become a singularity in circling around a polestar, but it does acknowledgement something common, something that unites the members of a polity in spite of their uniqueness and difference.
When President Washington stepped down after his second term; when President Lincoln emancipated the slaves; when FDR created the New Deal; when President Eisenhower called the Arkansas National Guard into Federal Service in order to integrate schools in Little Rock; these presidents acted in ways that helped refine, redefine, and re-imagine what it means to be an American.
Arendt makes one further point about action and freedom that is important as they relate to the question: Does the President Matter? Courage, she writes, is "the political virtue par excellence." To act in public is leave the security of one's home and enter the world of the public. Such action is dangerous, for the political actor might be jailed for his crime or even killed. Arendt's favorite example of political courage is Socrates, who was killed for his courageous engagement of his fellow Athenians. We must always recall that Socrates was sentenced to death for violating the Athenian law.
Political action also requires courage because the actor can suffer a fate even worse than death. He may be ignored. At least to be killed for one's ideas means that one is recognized as capable of action, of saying and doing something that matters. To be ignored, however, denies the actor the basic human capacity for action and freedom.
One fascinating corollary of Arendt's understanding of the identity of action and freedom is that action, any action—any original deed, any political act that is new and shows leadership—is, of necessity, something that was not done before. It is, therefore, always against the law.
This is an insight familiar to readers of Fyodor Dostoevsky. In Crime and Punishment Raskolnikov says:
Let's say, the lawgivers and founders of mankind, starting from the most ancient and going on to the Lycurguses, the Solons, the Muhammads, the Napoleons, and so forth, that all of them to a man were criminals, from the fact alone that in giving a new law they thereby violated the old one.
All leaders are, in important ways, related to criminals. This is an insight Arendt and Nietzsche too share.
Shortly after we began to plan this conference, I heard an interview with John Ashcroft speaking on the Freakonomics Radio Show. He said:
"Leadership in a moral and cultural sense may be even more important than what a person does in a governmental sense. A leader calls people to their highest and best. ... No one ever achieves greatness merely by obeying the law. People who do above what the law requires become really valuable to a culture. And a President can set a tone that inspires people to do that."
My first reaction was: This is a surprising thing for the Attorney General of the United States to say. My second reaction was: I want him to speak at the conference. Sadly, Mr. Ashcroft could not be with us here today. But this does not change the fact that, in an important way, Ashcroft is right. Great leaders will rise above the laws in crisis. They will call us to our highest and best.
What Ashcroft doesn't quite say, and yet Arendt and Dostoevsky make clear, is that there is a thin and yet all-so-important line separating great leaders from criminals. Both act in ways unexpected and novel. In a sense, both break the law.
But only the leader's act shows itself to be right and thus re-makes the law. Hitler may have acted and shown a capacity for freedom; his action, however, was rejected. He was a criminal, not a legislator. Martin Luther King Jr. or Gandhi also broke the laws in actions of civil disobedience. Great leader show in their lawbreaking that the earlier law had been wrong; they forge a new moral and also written law through the force and power of moral example.
In what is perhaps the latest example in the United States of a Presidential act of lawbreaking, President George W. Bush clearly broke both U.S. and international law in his prosecution of the war on terror. At least at this time it seems painfully clear that President George W. Bush's decision to systematize torture stands closer to a criminal act than an act of great legislation.
In many ways Presidential politics in the 21st takes place in the shadow of George W. Bush's overreach. One result is that we have reacted against great and daring leadership. In line with the spirit of equality that drives our age, we ruthlessly expose the foibles, missteps, scandals and failures of anyone who rises to prominence. Bold leaders are risk takers. They fail and embarrass themselves. They have unruly skeletons in their closets. They will hesitate to endure and rarely prevail in the public inquisition that the presidential selection process has become.
These candidates, who are inoffensive enough to prevail, are branded by their consultants as pragmatists. Our current pragmatists are Products of Harvard Business School and Harvard Law School. Mr. Romney loves data. President Obama worships experts. They are both nothing if not faithful to the doctrine of technocratic optimism, that we with the right people in charge we can do anything. The only problem is they refuse to tell us what it is they want to do. They have forgotten that politics is a matter of thinking, not a pragmatic exercise in technical efficiency.
Look at the Mall in Washington: the Washington monument honors our first President, the Jefferson Memorial, the Lincoln Memorial, the Memorial to Franklin Delano Roosevelt. There is not a monument to any president since FDR. And yet, just 2 years ago we dedicated the Martin Luther King Memorial. It doesn't seem like an accident that the leaders of the Civil Rights Movement were not politicians. Our leaders today do not gravitate to the presidency. The presidency does not attract leaders. Bold leaders today are not the people running for office.
Yet, people crave what used to be called a statesman. To ask: "Does the President Matter?" is to ask: might a president, might a political leader, be able to transform our nation, to restore the dignity and meaning of politics? It is to ask, in other words, for a miracle.
At the end of her essay, "What is Freedom?", Hannah Arendt said this about the importance of miracles in politics.
Hence it is not in the least superstitious, it is even a counsel of realism, to look for the unforeseeable and unpredictable, to be prepared for and to expect “miracles” in the political realm. And the more heavily the scales are weighted in favor of disaster, the more miraculous will the deed done in freedom appear.
She continued:
It is men who perform miracles—men who because they have received the twofold gift of freedom and action can establish a reality of their own.
I don't know if the president matters.
But I know that he or she must. Which is why we must believe that miracles are possible. And that means we, ourselves, must act in freedom to make the miraculous happen.
In the service of the not-yet-imagined possibilities of our time, our goal over the two days of the conference days was to engage in the difficult, surprising, and never-to-be-understood work of thinking, and of thinking together, in public, amongst others. We heard from philosophers and businessmen, artists and academics. The speakers came from across the political spectrum, but they shared a commitment to thinking beyond ideology. Such thinking is itself a form of action, especially so in a time of such ideological rigidity. Whether our meeting here at Bard gives birth to the miracle of political action--that is up to you. If we succeeded in thinking together, in provoking, and in unsettling, we perhaps sowed the seeds that will one day blossom into the miracle of freedom.

Small, Ugly, and Boring
As the father of an introvert I have been truly grateful for Susan Cain's recent mission to raise awareness of introversion and also the power of introverts. From her TED Talk to her book, Quiet, Cain has shown that our traditional bias towards extroverts can be both damaging and misguided. While children are prodded and rewarded for fitting in and playing gregariously with others, it is often the children who prefer the quiet of an imaginary friend that develop the independence, conviction, and clarity that may one day blossom into the surprising creativity of bold leadership.
In an essay in last Sunday's New York Times, Cain responded to recent comments that President Obama is hobbled by the fact that he is an introvert, that he does not like people, and that he is "concealed inside “a layer of self-protective ice."" She makes the important point that introverts often do like people, they just prefer intimate conversations and social situations to back-slapping expressions of outward gregariousness.
Cain also points out that both Obama and Mitt Romney are introverts, which means that whichever candidate wins the election, we will soon live through our second consecutive introverted presidency. That, writes, Cain, is a good thing. For Cain, introverts can be and often are excellent leaders.
Many of this nation’s finest leaders have been extroverts — but plenty have not. Jim Collins, in his study of the best-performing companies of the late 20th century, found that they were all led by chief executives known primarily for their fierce will and dedication — and were often described with words like “reserved” and “understated.”
Cain adds as this quote from management guru Peter Drucker:
“The one and only personality trait the effective [leaders] I have encountered did have in common, was something they did not have: they had little or no ‘charisma’ and little use either for the term or what it signifies.”
I fully accept Cain's basic claim that charisma is overrated and that the charisma of ideas can trump the charisma of social grace. That said, what the introverts Barack Obama and Mitt Romney share also is a technocratic faith. Romney believes, seemingly above all, in data. This is why he drives conservatives crazy and why he seems so fake in his attempts to appeal to the faithful of the right. Obama believes in nothing if not experts and commissions, which is why he surrounds himself with Ph.D.s and technocrats who continue to advise him on this program or that program. Products of Harvard Business School and Harvard Law School, Romney and Obama are nothing if not faithful to the doctrine of pragmatic optimism, that with a bit of hard work and rational analysis we can master our situation and make it better.
The problem with Romney and Obama is not that they are introverts, but that they are so struck by the power of expertise that they lack the power of ideas. At a time of crisis, when technology and globalization are bringing revolutionary changes to the fundamental assumptions of the way we live, people have lost the faith that our political leaders understand these transformations and have a vision of what our future might be. This election should be about a frank acknowledgement of the unsustainability of our economic, social, and environmental practices and expectations, and how we should remake our future in ways that are both just and exciting. This should be both a scary and an exciting election. Instead, it is small-minded, ugly, and boring. Introverts or extraverts, these candidates are not the leaders we need.

Did He Meet The Challenge?
In a recent post I outlined the President's challenge in his Convention speech thus:
The crises the President inherited are not his fault. It is disgusting to hear Paul Ryan and others blame the President for every problem in the United States. And despite Mitt Romney's impressive past history, his willingness to change his positions regularly and disavow past achievements raises serious questions about his own ability to lead. And yet, it is undeniable that after three years, the financial crisis is still with us and the political crisis is worse than ever. At some point, the President must take responsibility for his failure to address these crises and offer hope that he has a plan to address them in the future. That is the President's challenge during his convention speech next week. To somehow try to answer the criticism that after three years, we still don't know what it is that President Obama believes in and how he wants to respond to the financial and political crisis that he inherited.
Obama did make it clear that he and Mitt Romney offer two fundamentally different approaches to politics and to American life. The Republicans and Democrats do represent different versions of what it means to be Americans in the 21st century. There is a choice of values.
What the President did not do, however, is to show us that he understands the depth of the crisis we continue to struggle through or that American life as we have known it is changing radically. Nor therefore did he outline his vision of where he wants it to go. Eliot Spitzer seems to get this right:
Through this haze, however, a fundamental choice on values and policy did emerge—a choice clarified by the brilliance of Bill Clinton in his deconstruction of the Republican agenda and praise for Present Obama has done. Yet the reality of today's job numbers—only 96,000 net new jobs created and a work force participation rate of 63.5 percent, the lowest in 30 years—reaffirms what we already know: We are still in a serious crisis.
All of which is what left me feeling a bit empty after the president's speech: What exactly is the agenda for the next four years? His priorities are surely better than those of the Republicans. And give him credit: He even spoke directly about global warming. But it is not clear to me that he is ready to push for the genuine control of health care costs that might ensure that the government can afford the investments in the areas that most need it: education, infrastructure, basic R&D, and protection of the safety net for the poor.
The President may win simply because his values are understood to be better than Mitt Romney's and the Republican Party's. He at least understands that political life and patriotism demand that we see ourselves as part of a common project, not simply as a collection of radically atomized individuals. But in an individualistic age, in which we live, people need to believe in grand projects if they are to feel part of something bigger than themselves. The President continues to fail to provide such a narrative. In other words, he is not making the case that the President can and does Matter.

Why the President Matters in the 21st Century-Mateus Baptista
We face a challenge of leadership; there is a void in our body politics that remains to be filled. First, expectations of the president need to re-evaluated. The public’s perception of the president is unrealistic and inflated. A CBS News/New York Times poll in March 2012 reported that 54% of people believe the president “can do a lot” about gas prices.
Our economic recession adds another dimension to the public’s bloated expectations. In the wake of the 2008 economic recession all eyes turned on what the President-elect would do once in office. People believed and still do that the President had the ability to fix the global economic meltdown. The public expected the President to solve our economic problem without understanding that in the globalized neo-liberal regime markets are highly connected. It is no longer possible for a single country to ameliorate the effects of an economic meltdown.
The president will only matter in this century if it is first addressed how we perceive the president. He is neither a deity nor a dictator. His actions in an increasingly filibuster-happy congress are limited. The public’s expectations must be re-evaluated and shaped to accept reality. The president cannot solve all our problems; the very fabric of the American constitution prohibits the president from securing more powers. The justified fear of an autocrat prohibits action. This tradeoff was accepted by the founding fathers and it must now be accepted again.
Once expectations are adjusted, how then does the president matter? The president will matter as long as he can engage citizens in our democratic process. The pervasive idea that democracy is simply voting has filled the minds of millions. The civic and democratic institutions lie asleep in times where the market prevails. People have given up on government; they see it as an artifact to be studied in history books. The president must see his role as protector of our democracy; he must be its biggest champion. This cannot only be done through rhetoric alone. The president must help foster an engaged citizenry that actively participates in our democracy.
The danger to our politics does not come from terrorist it comes from a citizenry that is not informed, does not participate, and could care less. When the media suggests the president must rise above politics the only way that can be done is to address the inherent problems in our current political system. It is to remind citizens of the price paid by their forefathers for political rights. The president must become the chief persuader thereby helping bring citizens into the political fold. The only way for the president to matter in this century is for people to see him as a protector of this great experiment and not merely as passerby.
These leaders will come from the left and the right alike, engaging citizens should not be a partisan issue. They must also come with a historical understanding of our democracy and American institutions. This does not mean they will rise from academia, but that their understanding cannot be informed by current political debates but rather by history. New political leaders must accept a non-politicized history that seeks truth.
Facts have become politicized, each side molding it to their own advantage. Objective truths are irrelevant because each side has been allowed to massage it. On August 28, 2012 New Jersey Governor Chris Christie lied by omission. He gave the keynote address at the Republican National Convention claiming that there has been a New Jersey come back. That his policies have worked and all it takes is serious leaders to tackle our problem. He claims he cut the state deficit while decreasing taxes. The governor forgets to mention he also cut pensions, teachers, firefighters, and many others. What is more glaring is New Jersey’s unemployment rate at over 9%.[1] The myth is created allowing Governor Christie to become a hero in the Republican Party. The truth does not lie with either party. A new leader must inform citizens of the reality rather than try to score political points. This may be impossible but it is the only way that the president will matter.
People are tired of the partisan bickering; Obama’s unemployment rate is just as bad as Governor Christie’s and yet both sides claim victory. A president will not matter until he can acknowledge the fundamental problems at hand. For a leader to matter he must stand for something greater than his own party. He must stand for citizen participation and access to information. A leader would not claim victory but would relate to citizens the problems we face and the solutions they believe will solve it. They must acknowledge when those solutions do not work. It is a pragmatic president that will matter in this century, one who is willing to suffer the consequences of failed policies for democracies sake.
The Millennial generation will inherit a troubled world by the year 2040. Their ability to lead will prove extremely important. They will be the heirs to the American dilemma. The hope is that they rise and fill the leadership void not as past generations have done, but as new leaders different and emboldened by a fight for a vibrant participatory democracy. It is John Dewey that should inform what a new president needs to fight for. “[T]he task of democracy is forever that of creation of a freer and more humane experience in which all share and to which all contribute.”[2]

Seeking a Political Genius—In Vain?
It is cliché to say that a presidential election is important. And yet, the 2012 presidential election may be one of the most decisively meaningful elections in recent history. The world is now in year four of the global financial crisis. In addition to economic retraction that may last decades, there is social dislocation and political unrest. The level of frustration and cynicism is reaching all-time highs. And as Congress, the President, the Supreme Court, Universities, and businesses record their lowest levels of public trust and integrity, the only major U.S. institutions that continue to be well respected in public polls are the army and the police. If we do not somehow elect a President who can begin to halt or reverse the descent into political paralysis, the risks to the United States are enormous.
We are in need of a political genius, as Peggy Noonan wrote this month in the Wall Street Journal:
Why do people think we need a kind of political genius? Because they know exactly how deep our problems are and exactly how divided our nation is. We need a president who knows and understands politics because he knows and understands people and can galvanize them. When he speaks, you listen, in part because you believe he'll give it to you straight, in part because his views seem commonsensical, in part because something in his optimism pings right into your latent hopefulness, and in part because he's direct and doesn't hide his meaning in obfuscation, abstraction, clichés and dead words.
As much as we need an inspired political leader, it is clear beyond a doubt that neither Barack Obama nor Mitt Romney is such a leader. The result is that this election is as depressing as it is boring.
The promise of a Romney-Obama matchup is terrifying not simply because one of them will win; but more, because it is so obvious that these two politicians who actually are so similar in temperament and worldview would never actually engage in a contest of ideas. We have two candidates who are, quintessentially, moderate technocrats. Both are products of Harvard professional schools. Both candidates are essentially risk-averse technocrats. One worships data. The other worships experts. And both will do and say anything to win.
It is hard not to wish that Newt Gingrich had won the Republican nomination. At least his promise of hounding Obama to debate the core issues of American governance promised a consequential and engaging campaign.
Instead, this is a campaign not of ideas but of consultants. David Brooks, who writes today that the upcoming election is "incredibly consequential and incredibly boring all at the same time," gets this right:
Candidates know that they’d be punished for saying something unexpected — by the rich, elderly donors and by the hyperorthodox talk-show hosts. Instead of saying something new, now they just try to boost turnout within their own demographic niches and suppress turnout in the other guy’s niches.
Hannah Arendt taught that politics is about action that is spontaneous and surprising. Political action needs to be courageous and new, since only unexpectedly bold action can galvanize and unite a people. The political actor is one who can inspire, but inspiring action must above all be risky and extraordinary. For Arendt, freedom demands such leadership if life is to remain surprising, new, and human.
As Roberto Mangabeira Unger argued recently, we need a political leader who brings a wartime mentality to our contemporary crisis. Peggy Noonan from the right agrees. From all sides there is a longing for just such political leader, one that candidate Barack Obama promised to be four years ago. The falsity of that promise has hardened people against hope. The cynicism and dishonesty of both candidates is numbing. It is further diminishing our political culture, at a time when we hardly thought politics could sink lower and we can hardly afford to allow it to do so.

What would it mean to elect a leader who could revive American politics? That is, in fact, the question asked in the upcoming Arendt Center Conference, "Does the President Matter? Reflections on the American Age of Political Disrepair."
On the most obvious level, the President does matter. Of course some will benefit under President Romney and others under President Obama. But on the level that matters most—the regeneration of the political life of the United States—it is hard to see how this election means anything. Neither candidate is speaking to the whole country and neither has the ambition or the spark to inspire us to overcome the limitations of our selfishness, weakness and fear and get us to do better, harder, and more common things than we can do on our own.

Ashcroft on Leadership

"Leadership in a moral and cultural sense may be even more important than what a person does in a governmental sense. A leader calls people to their highest and best. ... No one ever achieves greatness merely by obeying the law. People who do above what the law requires become really valuable to a culture. And a President can set a tone that inspires people to do that."
Ashcroft is right. Great leaders will rise above the laws in crisis. They will call us to our highest and best. Plato distinguishes between shepherds and kings. Shepherds care for their flocks. Kings lead. There is an important distinction to be recalled.
What Ashcroft doesn't say is that there is a thin and yet all-so-important line separating great leaders from criminals. Both break the law. But only the leader's act shows itself to be right and thus re-makes the law. A great leader shows the earlier law to have been wrong and forges a new moral and also written law through the force and power of moral example. Raskolnikov knew that leaders and criminals were of a kind; he also knew he was not the great man he wanted to be.
Ashcroft also forget to mention that it is one thing for a President to call on people to reach their highest selves beyond the law. It is another thing altogether for the Attorney General of the United States.
Our problem today is that we are too afraid of Presidents who might lead, and for good reason. The quality of our leaders is weak. They cannot be trusted to lead us without constraints. The result is we recoil from leadership and our politics loses all spontaneity, all freedom, and all possibility of starting something new.

A Brief History of Campaign Finance

The NY Times penned one of those editorials Wednesday that makes one wonder who is home. The Times takes President Obama to task for forming a Super PAC--or for having someone form a Super PAC for him, because we know there is no coordination between the Super PAC and the Super PAC's beneficiary. As cynical as the current Super PAC frenzy is, and as disheartening as the crush of money being spent by the Republican Super PACs and hoarded by Karl Rove's Super PAC is, what would be served by President Obama refusing to feed at the trough? Recall, he is the first Presidential candidate since 1974 to opt out of the public matching funds system. The idea that he might run as an anti-big-money candidate is hard to imagine, so how could he meaningfully run a campaign claiming on principle to be opposed to the influence of big money, as the Times editorial suggests.

I am in Berlin where on Monday I gave a Keynote Talk to open the State of the World Week in Berlin, sponsored by the European College of Liberal Arts of Bard. My talk was on the Citizen United court case, the case that opened the door to Super PACs. I'll be blogging more about Campaign Finance Reform as the election progresses. But for now, here is a short excerpt of one part of my talk that offered a condensed history of Campaign Finance and Campaign Finance Reform in the United States.
We can divide the history of Campaign finance in the U.S. into 7 stages.
1. The first stage is the pre-History involving the 1787 Constitutional Convention. As Zephyr Teachout has shown, "Corruption was discussed more often in the Constitutional Convention than factions, violence, or instability. It was a topic of concern on almost a quarter of the days that the members convened." Teachout and Lawrence Lessig have argued that there was a strong sense among the founding fathers that the great threat to new Constitution was corruption. And they have pointed to a number of practical responses to that threat in the Constitution itself. These include Article I, Section 6, Clause 2, which prevents members of Congress from holding civil office while serving as a legislator, or from being appointed to offices that had been created—or in which the compensation was increased—during their tenure. The point was to prevent members of Congress from using their posts to enrich themselves and their friends.
Another innovation aimed to prevent corruption was the decision to have those in the House of Representatives serve only for two years. According to Teachout and Lessig, this was designed to counter the formation of bonds between legislators and the President. By turning over the members of the House on a regular basis, it would be less likely that the Representatives would form strong alliances with members of the Executive branch, thus helping to maintain their independence. The founding fathers would surely be astounded by the incumbent advantages apparent today.
2. The Second stage of American campaign finance history runs from the passage of the Constitution until the election of Andrew Jackson in 1828. In early U.S. elections, most campaign expenses were paid directly by the candidates using their own money. Such expenses were relatively minimal, going toward an occasional campaign pamphlet and, sometimes, for food and drink at rallies. As Bradley Smith writes, "Though free from the "corrupting" effects of money, elections in this early period were generally contested by candidates representing aristocratic factions standing for election before a relatively small, homogeneous electorate of propertied white men."
3. The financing of American political campaigns begins to become interesting in 1828, with the election of Andrew Jackson. Jackson's presidency is rightly seen as the true beginning of modern American democracy. And Jackson's campaign for President was the first presidential campaign that appealed directly to the voters and not simply to party elites. Jackson's campaign was organized by Martin van Buren (who later served as his Vice President and thereafter as President). Van Buren was one of the original machine politicians from New York who created the machine concept Boss William Tweed would perfect later in the century at Tammany Hall. What Van Buren did for Jackson was to organize a campaign aimed at the people. This cost money. And what he and Jackson did was to raise money from those who were seeking jobs in the government. This was the beginning of the spoils system, whereby political campaigns were funded by current and prospective government employees; these employees in turn expected to be rewarded with jobs once their candidate won the election.
4. The spoils system lasted until the passage of the Pendleton Act, in 1883, which inaugurates the fourth stage of the development of campaign finance. The Pendleton Act professionalized the Federal Civil Service, instituting an exam for entry into the service and outlawing the Spoils system. The result was that campaign funds from federal officeholders dried up, and politicians needed new sources of funds. The obvious sources were wealthy individuals and corporations. And oh boy did corporations jump into the breach. By the late 19th century, the government was giving grants of land and cash to corporations, and in return the corporations were generously funding political campaigns. In 1888 40%, of Republican national campaign funds came from Pennsylvania manufacturing and business interests. By 1904, 73% of Teddy Roosevelt's presidential campaign funds were raised from corporate contributions. (I take these numbers from Bradley Smith). The age of corporate funded campaigns was here, and it has never left.

5. Once he was elected, Teddy Roosevelt made it a priority to reform the broken campaign financing system that he had exploited so well. With his support, Congress passed the Tillman Act in 1907, which made illegal all campaign contributions from corporations. The Tillman Act opens the Fifth stage of the development of Campaign Finance Reform in the United States.
While the Tillman Act carried penalties for its violation, it instituted no enforcement mechanism. The result is that not much changed. To take only one legendary example, in 1968 and 1972 Clement Stone contributed up to $10 million to President Richard Nixon's Presidential campaigns. Stone's contributions caused a scandal that, together with the outrage over Watergate, led Congress to finally institute a serious attempt at campaign finance reform.
6. The key moment of modern campaign finance reform is the passage of the Federal Election Campaign Act (FECA) in 1974, and the Supreme Court's partial upholding and partial overturning of that law in Buckley v. Valeo in 1976. In the wake of Watergate and the loss of trust in government, the Congress passed FECA which: limited individual contributions to individual candidates to $1,000; limited the amount candidates could spend on a campaign; established a system of public financing of campaigns that required a voluntary limit on campaign expenditures; required that candidates, parties, PACs and groups engaging in express advocacy disclose their fund-raising and spending; and created the Federal Elections Commission, to regulate and enforce the new rules.
In a landmark decision that still controls all legal approaches to the regulation of campaign financing, the Supreme Court in Buckley v. Valeo upheld the disclosure requirement and the limits on individual contributions. It also upheld the limits on campaign spending when those limits were voluntary and in conjunction with the decision to accept public financing. But the Court struck down compulsory limits on spending both by individual candidates and by PACs and other groups. While the Court recognized that limits on campaign spending were a kind of censorship that limited the rights of people and corporations to speak about the most central political issues of the day, it also acknowledged "large contributions threaten the integrity of our system of representative democracy." Because large contributions, especially to individual candidates, at the very least appear to suggest a kind of quid pro quo corruption, the Court accepted that Congress has the right to censor such expressions of support. More general expenditures not given to or coordinated with a specific candidate were, the Court argued, not examples of the kind of corruption that would allow Congress to override the fundamental free speech interests of individuals and corporations who would want to influence the political debate. Thus, post-Buckley, the rule was: The Constitution limits censorship of political activity, political speech and political spending on campaigns. Any limit is censorship that violates the First Amendment. And yet the Court carved out One Narrow Exception: speech or activity that either is or gives the appearance of quid pro quo corruption could be regulated and banned.
In the aftermath of Buckley v. Valeo, money continued to pour into politics. Candidates and their supporters made use of "soft money," money given to political parties and other groups and thus not subject to the limits imposed on individual contributions to individual candidates. PACS began to bundle large sums of money that, while not individual contributions to candidates, nevertheless carried the tint of influence peddling. In the year 1993-94, the Democratic Party received $45 Million dollars in "soft money" and the Republic Party received $59 Million. By 1999-2000, the numbers were $92 Million and $244 Million respectively. In 2001-2002, the Democratic Party took in $200 Million and the Republicans $421 Million.
7. The failure of FECA to stem the tsunami of money in elections led Congress to try again, and in 2002 it passed the Bi-Partisan Campaign Reform Act (BCRA), also known as the McCain-Feingold Act—the seventh and until now final stage of the effort to regulate campaign finance in the United States. The main innovation of BRCA was to prohibit unlimited soft money contributions by corporations and unions. And it was this provision that was held to be unconstitutional by the Supreme Court in the now infamous case of Citizens United v. FEC.

The core of the Citizens United ruling was Justice Anthony Kennedy's argument that "If the First Amendment has any force, it prohibits Congress from fining or jailing citizens, or associations of citizens, for simply engaging in political speech." For Kennedy, "The censorship we now confront is vast in its reach." What he means is that the law bans all those corporations—including large multinationals and also small mom and pop stores and even non-profit corporations—from expressing their views about political candidates for either 30 or 60 days leading up to an election.
In Kennedy's telling, corporations are part of the country and, what is more, an important part of the country. The Government has “muffle[d] the voices that best represent the most significant segments of the economy." Here Kennedy channels Felix Frankfurter, who in the 1941 case of U.S. v.s. Congress of Industrial Organizations, wrote:
To say that labor unions as such have nothing of value to contribute to that process and no vital or legitimate interest in it is to ignore the obvious facts of political and economic life and of their increasing interrelationship in modern society.
U.S. v. C.I.O. dealt with the anti-Union Smith Act, which forbade unions and corporations from using treasury funds to pay for politicking. In this regard, the Smith Act was very much like 2002 Bipartisan Campaign Reform Act. While the majority of the Court refused to consider the Constitutional Question and decided the case on narrow grounds, Frankfurter did. In his telling, the Court must take seriously the evil that Congress sought to address: namely, the corruption of elections and federal officials by the expenditure of large masses of aggregated wealth. And yet, Frankfurter saw that "the claimed evil is not one unmixed with good." The expression of corporate or union speech in elections is, he writes, a good thing! "The expression of bloc sentiment has always been an integral part of our democratic and legislative processes." Replace "Labor unions" with "corporations." That is what Kennedy did.
