“Between Sovereign states there can be no last resort except war; if war no longer serves that purpose, that fact alone proves that we must have a new concept of the state.”

No government exclusively based on the means of violence has ever existed. Even the totalitarian ruler, whose chief instrument of rule is torture, needs a power basis—the secret police and its net of informers. Only the development of robot soldiers, which, as previously mentioned, would eliminate the human factor completely and, conceivably, permit one man with a push button to destroy whomever he pleased, could change this fundamental ascendancy of power over violence.

Hannah Arendt wrote these lines in the midst of the United States’ defeat in Vietnam. Her argument was that as long as robot soldiers were a thing of the future, brute violence and force like that unleashed by the United States would always succumb to collective power, of the kind exhibited by the Vietcong. Hers was, at least in part, a hopeful voice, praising the impotence of violence in the face of power.
To read Arendt’s lines today, amidst the rise of drone warfare, alters the valence of her remarks. Drones are increasingly prototypes and even embodiments of the “robot soldiers” that Arendt worried would dehumanize war and elevate violence over power. If we draw out the consequences from Arendt’s logic, then drone soldiers might displace the traditional limits that politics places on violence; drones, in other words, make possible unprecedented levels of unlimited violence.
The rise of drones matters, Arendt suggests, in ways that are not currently being seen. Her worry has little to do with assassination, the concern of most opponents of drones today. Nor is she specifically concerned with surveillance. Instead, against those, like General Stanley McChrystal, who argue that drones are simply new tools in an old activity of war, Arendt’s warning is that drones and robot soldiers may change the very dynamic of war and politics.
To see how drones change the calculus of violence in politics, we need to understand Arendt’s thesis about the traditional political superiority of power over violence. The priority of power over violence is based on the idea that power is “inherent in the very existence of political communities.” Power, Arendt writes, “corresponds to the human ability not just to act, but to act in concert.” It “springs up whenever people get together and act in concert.” All government, and this is central to Arendt’s thesis, needs power in order to act.
This need for popular support is true even for totalitarian governments, which also depend on the power of people—at least a select group of them like the secret police and their informers—continuing to act together. It is thus a myth that totalitarian rule can exist without the support of the people. Whether in Nazi Germany or contemporary Syria, totalitarian or tyrannical governments still are predicated on power that comes from support of key segments of the population.
Even if all government is predicated on some power, governments also employ violence—but that violence is held in check by political limits. As a government loses its popular support, it finds itself tempted to “substitute violence for power.” The problem is that when governments give in to the temptation to use violence to shore up slackening of popular power, their use of violence diminishes further their power and results in impotence. The more violence a government needs to rely upon, the less power it has at its disposal. There is thus a political limit on how much violence any government can employ before it brings about the loss of its own power.
As much as she respects the claims for power over violence, Arendt is clear-eyed about the damage violence can wield. In a direct confrontation between power and violence, violence will win—at least in the short term. Arendt writes that if Gandhi’s “enormously powerful and successful strategy of nonviolent resistance” had met a different enemy—a Stalin or Bashar al-Assad instead of a Churchill or Mubarek—“the outcome would not have been decolonization, but massacre and submission.” Sheer violence can bring victory. But the price for such a triumph is high, not only for the losers, but also for the victors.
We see this exemplified in Middle East over the last few years. In those countries like Bahrain and Syria where governments did not shy from unlimited violence to repress popular revolts, the governments have maintained themselves and the Arab Spring has turned into a long and frigid winter. Assad has been able to maintain power; but his power is irreparably diminished. In the end, there is a limit to the viability and effectiveness of relying on mere violence at the expense of power. This is even more true in a constitutional democracy, where support of the people is a political necessity.
As confident as Arendt is that violence is limited in politics by the need for power, she worries that the coming age of “robot soldiers” might bring about the end of the political advantage power has over violence. Robot soldiers can be controlled absent of consent or political support. With the push of a button or a simple command, a tyrant or totalitarian ruler can exert nearly unlimited violence and destruction, even without the support a massive secret police or a network of informers. Drones threaten the time-immemorial dependence of even the most lonely tyrant on others who will support him and do his bidding.
Of course drones must be built, programmed, and maintained. No tyrant is fully autonomous. Yet building, programming, and maintaining machinery are fundamentally different jobs than arresting and killing dissenters. It is far easier for programmers and electricians to justify doing their jobs in a powerless yet violent state than for soldiers and secret agents to justify theirs.
In a drone-led war, men will rarely need to go into action as soldiers. That is of course one reputed advantage of drones, that they make war less dangerous and more technically predictable. But it also means that as modern warfare becomes safer and more humane, it also excludes without human soldiers and risks stripping war of its human and active character. This helps to explain an enigmatic passage of Arendt’s in The Human Condition, where she offers modern war as an example of when action “loses its specific character” as human action and “becomes one form of achievement among others.” The degradation of human action in modern war, she writes,
happens whenever human togetherness is lost, that is, when people are only for or against other people, as for instance in modern warfare, where men go into action and use means of violence in order to achieve certain objectives for their own side against the enemy. In these instances, which of course have always existed, speech becomes indeed ‘mere talk,’ simply one more means toward the end….
Arendt is here thinking of the anonymity of the modern soldier epitomized by the monuments to the unknown soldiers—the mute mass of humanity who fight and die without the “still existing need for glorification” that makes war a human instead of a merely mechanical activity.
Her modern warfare in its inhumanity and technological capacity abandons the togetherness that has traditionally made war a prime example of human political togetherness.
In the technological advances of modern warfare that made war so awful and so mechanical, Arendt actually found a glimmer of hope: that war’s rabid violence was compensated by neither political advantage nor personal glory. In On Revolution, she dared hope that the fact that technology had reached the stage “where the means of destruction were such as to exclude their rational use” might lead to a “disappearance of war from the scene of politics….” It was possible, she thought, that the threat of total war and total destruction that accompanies war in the modern era might actually lead to the disappearance of war.
Clearly such a hope has not come to pass. One reason for the continuation of war, however, is that the horrors of war are made ever more palatable and silent—at least to the victors—by the use of technology that exerts violence without the need for political power and participation. The drone wars of the early 21st century are in this respect notable for the unprecedented silence that accompanies violence. Since U.S. soldiers are rarely injured or killed and since the strikes are classified and the damage remote, we have indeed entered an era where we can fight wars absent the speech, glory, and “human togetherness” that has traditionally marked both the comradeship of soldiers and the patriotic sacrifice of a nation at war. It is in this extraordinary capacity of mute violence to substitute for power in which we can glimpse both the promise and the peril of drones.
Over the course of the past two decades, the political idiom of liberalism has substantially expanded its global reach and dominance. In the vast majority of the world’s existing states, principles of individual rights and collective recognition have been or are being enshrined in constitutions and other legal codes, and actors in the public sphere and the realm of civil society are adopting liberal discourse in order to press their claims for equality and freedom. The recent Arab Spring is only one of the most recent instantiations of this larger trend.
Yet even as we acknowledge liberalism’s dominance, we should not overlook those settings where it still (and ironically) carries a counter-hegemonic charge. One such locale is the Republic of Turkey, ostensibly one of the most stable and democratic states in the wider Middle East. Here a variety of Islamic organizations have relied on liberal imaginings in their efforts to challenge the state’s anti-clerical model of secularism.
This Islamic recourse to liberalism is the central concern of Jeremy Walton’s intriguing article in the most recent American Ethnologist, “Confessional Pluralism and the Civil Society Effect.” Walton pays particular attention to the work of four Islamic NGOs in Istanbul and Ankara, all of which have adopted the language of confessional pluralism in their efforts to obtain recognition from the state and secure their inclusion in Turkish public life.[i] These organizations define “religion” as a nonpolitical, voluntary mode of social and ethical life that legitimately, indeed necessarily, takes different forms. They also insist that these varied modes of life deserve acknowledgement and protection on the basis of “the ostensibly universal values of liberty and equality.”
When viewed from the perspective of Turkey’s party politics, these NGOs make strange bedfellows. Three of the organizations analyzed by Walton represent Alevism, a syncretic minority tradition that can be broadly defined by its emphasis on Twelver Shi’a history and belief, its incorporation of Central Asian mystical and shamanistic practices, and its distinctive ritual performances. Alevis have typically supported the Republican People’s Party (CHP, the party established by Mustafa Kemal Atatürk) because its staunch secularism has appeared to offer a bulwark against Sunni majoritarianism and discrimination. The fourth organization, meanwhile, is a Sunni association inspired by the contemporary Turkish theologian Fethullah Gülen and his project of universal religious dialogue. It also epitomizes the recent emergence of the Sunni Muslim bourgeoisie, the constituency that has played a pivotal role in the ascendance of the Justice and Development Party (AKP) under Prime Minister Recep Tayyip Erdoğan. Thanks to its overwhelming success in local and national elections over the past decade, the AKP has effectively supplanted the CHP as Turkey’s preeminent political party.
Yet as Walton rightly notes, these NGOs’ seemingly obvious political differences belie their common turn to the liberal rhetoric of pluralism and collective recognition. All of them desire public acknowledgement of their own (and others’) communities and identities, and all thereby challenge the presumption of ethnolinguistic and religious homogeneity that has prevailed in Turkish governmental discourse since the founding of the Republic in 1923. In addition, all of these organizations question the state’s long-standing effort not only to define and regulate the legitimate practice of religion (especially Sunni Islam), but also to limit religious expression to the private sphere. These rather paradoxical governmental imperatives, which remained largely unchallenged in Turkey until the 1990s, can be traced to the laicist model of secularism that the Republic adopted from the French Jacobin tradition.
In subtle or dramatic ways, all of these NGOs seek to divert Turkish secularism from its previous path. One of the Alevi organizations, for example, seeks a mode of pluralism that would grant to Alevis the same privileges—state funding for houses of worship, inclusion in the mandatory religion classes taught in public schools—that the state has historically allocated to Sunni Islam. Another Alevi association, by contrast, favors an “American-style” secularism that would limit or even prohibit state intervention in religious affairs. The Sunni organization, meanwhile, seeks to promote tolerance and public dialogue across confessional boundaries in a manner that departs markedly from the state’s efforts to privatize religious expression. Significantly, the idiom of liberalism is flexible enough to accommodate these varied and not always compatible projects.
At the same time, the liberal language of confessional pluralism creates tensions and dilemmas for the very organizations that seek to mobilize it. Above all, claims for collective recognition presume coherent and “authentic” (i.e., long-standing, non- or pre-political) religious identities as the necessary ground for communal acknowledgement and equal protection. As Walton convincingly relates, it is precisely such coherence and authenticity that prove elusive for many Islamic NGOs. Alevi associations in particular are defined by intense arguments over the very definition of Alevi identity. Does Alevism constitute a distinct and more or less uniform tradition of its own? What precisely is its relationship with Islam? Does Alevism even constitute a “religion” as the concept is commonly understood, or is it rather a body of folklore, a philosophical and political orientation, or an ethnicity? Alevi associations disagree sharply on the answers to these questions, even as they share a common discursive logic.
Walton is somewhat less persuasive, however, when he turns to Islamic NGOs’ relationship to the state and state governance. In his reading, these associations engage in a form of “nongovernmental politics” that does not aspire to occupy the position of a governing agency. In fact, they contribute to what Walton, drawing on the work of Timothy Mitchell, calls “the civil society effect”: the romantic notion that civil society constitutes “a self-evident domain of freedom and authenticity” wholly autonomous from the state. I follow Walton’s reasoning when he notes that the NGOs he analyzes have displayed an increasing skepticism toward Turkey’s dominant model of secularism and its major political parties, including the CHP and the AKP. I believe he oversteps, however, when he suggests that many if not all of these associations dismiss political society and the state. To my mind, the very language of liberalism adopted by these NGOs indicates that they care a great deal about the state and its policies. Very much in the spirit of Arendt’s celebrated pronouncements in The Origins of Totalitarianism, they grasp that rights and recognition, if they are to have real substance, must be backed and warranted by the state’s governmental power.
This wrong turn notwithstanding, Walton’s argument makes for stimulating reading. Perhaps above all, it offers a sharp challenge to the still common presumption that Islam and modern politics are hermetically separate, fundamentally irreconcilable domains. Instead, as Walton subtly demonstrates, they “authorize, animate, challenge, and contextualize each other in contextually specific ways.”
[i] For the sake of easy reading, I do not dwell on the NGOs by name, but the Alevi associations include the Cem Foundation, the Hacı Bektaş Veli Anatolian Cultural Foundation, and the Ehl-i Beyt Foundation. The Sunni association aligned with Gülen is the Journalists and Writers Foundation.
What is a fact? Few more thorny questions exist. Consider this, from Hannah Arendt’s essay, “Truth and Politics:”
But do facts, independent of opinion and interpretation, exist at all? Have not generations of historians and philosophers of history demonstrated the impossibility of ascertaining facts without interpretation, since they must first be picked out of a chaos of sheer happenings (and the principles of choice are surely not factual data) and then be fitted into a story that can be told only in certain perspective, which has nothing to do with the original occurrence?
Facts are constructed. They are not objective. And there is no clear test for what is a fact. Thus, when Albert Einstein was asked, how science can separate fact from fiction, brilliant hypotheses from nutty quackery, he answered: ‘There is no objective test.” Unlike rational truths that are true outside of experience and absolute, all factual truths are contingent. They might have been otherwise. That is one reason it is so hard to pin them down.
Steve Shapin reminds us of these puzzles in an excellent essay in this weeks London Review of Books. Shapin is reviewing a new book on Immanuel Velikovsky by Michael Gordin. Velikovsky, for those born since the 1960s, caused an uproar in the 1960s and 70s with his scientific claims that Venus was the result of a dislodged piece of Jupiter, that comets led to the parting of the Red Sea, that it dislodged the orbit of Mars threatening Earth, and caused the relocation of the North Pole, not to mention the showering of plagues of vermin onto the earth that nourished the Israelites in the desert.
Gordin’s book is about how American scientists went ballistic over Velikovsky. They sought to censor his work and schemed to prevent the publication of his book, Worlds in Collision, at the prestigious Macmillan press. At the center of the controversy was Harvard, where establishment scientists worked assiduously to discredit Velikovsky and stop the circulation of his ideas. [I am sensitive to such issues because I was also the target of such a suppression campaign. When my book The Gift of Science was about to be published by Harvard University Press, I received a call from the editor. It turns out an established scholar had demanded that HUP not publish my book, threatening to no longer review books for the press let alone publish with them. Thankfully, HUP resisted that pressure, for which I will always be grateful.]
For these Harvard scientists, Velikovsky was a charlatan peddling a dangerous pseudo science. The danger in Velikovsky’s claims was more than simple misinformation. It led, above all, to an attack on the very essence of scientific authority. What Velikovsky claimed as science flew in the face of what the scientific community knew to be true. He set himself up as an outsider, a dissident. Which he was. In the wake of totalitarianism, he argued that democratic society must allow for alternative and heretical views. The establishment, Velikovsky insisted, had no monopoly on truth. Let all views out, and let the best one win.
Shapin beautifully sums up the real seduction and danger lurking in Velikovsky’s work.
The Velikovsky affair made clear that there were radically differing conceptions of the political and intellectual constitution of a legitimate scientific community, of what it was to make and evaluate scientific knowledge. One appealing notion was that science is and ought to be a democracy, willing to consider all factual and theoretical claims, regardless of who makes them and of how they stand with respect to canons of existing belief. Challenges to orthodoxy ought to be welcomed: after all, hadn’t science been born historically through such challenges and hadn’t it progressed by means of the continual creative destruction of dogma? This, of course, was Velikovsky’s view, and it was not an easy matter for scientists in the liberal West to deny the legitimacy of that picture of scientific life. (Wasn’t this the lesson that ought to be learned from the experience of science in Nazi Germany and Stalinist Russia?) Yet living according to such ideals was impossible – nothing could be accomplished if every apparently crazy idea were to be given careful consideration – and in 1962 Thomas Kuhn’s immensely influential Structure of Scientific Revolutions commended a general picture of science in which ‘dogma’ (daringly given that name) had an essential role in science and in which ‘normal science’ rightly proceeded not through its permeability to all sorts of ideas but through a socially enforced ‘narrowing of perception’. Scientists judged new ideas to be beyond the pale not because they didn’t conform to abstract ideas about scientific values or formal notions of scientific method, but because such claims, given what scientists securely knew about the world, were implausible. Planets just didn’t behave the way Velikovsky said they did; his celestial mechanics required electromagnetic forces which just didn’t exist; the tails of comets were just not the sorts of body that could dump oil and manna on Middle Eastern deserts. A Harvard astronomer blandly noted that ‘if Dr Velikovsky is right, the rest of us are crazy.'
It is hard not to read this account and not think about contemporary debates over global warming, Darwinism, and the fall of the World Trade Center. In all three cases, outsiders and even some dissident scientists have made arguments that have been loudly disavowed by mainstream scientists.
No one has done more to explore the claims of modern pseudo science than Naomi Oreskes. In her book Merchants of Doubt written with Erik Conway, Oreskes shows how “a small handful of men” could, for purely ideological reasons, sow doubt about the ‘facts’ regarding global warming and the health effects of cigarettes. In a similar vein, Jonathan Kay has chronicled the efforts of pseudo scientists to argue that there was no possible way that the World Trade Towers could have been brought down by jet fuel fires, thus suggesting and seeking to “prove” that the U.S. government was behind the destruction of 9/11.
Oreskes wants to show, at once, that it is too easy for politically motivated scientists to sow doubt about scientific fact, and also that there is a workable and effective way for the scientific community to patrol the border between science and pseudo science. What governs that boundary is, in Oreskes words, “the scientific consensus.” The argument that global warming is a fact rests on claims about the scientific method: value free studies, evaluated by a system of peer review, moving towards consensus. Peer review is, for Oreskes, “is a crucial part of science.” And yet, for those who engage in it know full well, peer review is also deeply political, subject to petty and also not so petty disputes, jealousies, and vendettas. For this and other reasons, consensus is, as Oreskes herself admits, not always accurate: “The scientific consensus might, of course, be wrong. If the history of science teaches anything, it is humility, and no one can be faulted for failing to act on what is not known.”
Just as Einstein said 50 years ago, in the matters of establishing scientific fact, there is no objective test. This is frustrating. Indeed, it can be dangerous, not only when pseudo scientists sow doubt about global warming thus preventing meaningful and necessary action. But also, the pervasive and persuasive claims of pseudo science sow cynicism that undermines the factual and truthful foundations of human life.
Arendt reminds us, with a clarity rarely equaled, that factual truth is always contingent. “Facts are beyond agreement and consent, and all talk about them—all exchanges of opinion based on correct information—will contribute nothing to their establishment.” Against the pseudo scientific claims of many, science is always a contingent and hypothetical endeavor, one that deals in hypotheses, agreement, and factual proof. Scientific truth is always empirical truth and the truths of science are, in the end, grounded in consensus.
The trouble here is that scientific truths must—as scientific—claim to be true and not simply an opinion. Science makes a claim to authority that is predicated not upon proof but on the value and meaningfulness of impartial inquiry. It is a value that is increasingly in question.
What the challenge of pseudo science shows is how tenuous scientific authority and the value placed on disinterested research really is. Such inquiry has not always been valued and there is no reason to expect it to be valued about partial inquiry in the future. Arendt suggests that the origin of the value in disinterested inquiry was Homer’s decision to praise the Trojans equally as he lauded the Achaeans. Never before, she writes, had one people been able to look “with equal eyes upon friend and foe.” It was this revolutionary Greek objectivity that became the source for modern science. For those who do value science and understand the incredible advantages it has bestowed upon modern civilization, it is important to recall that the Homeric disinterestedness is neither natural nor necessary. In the effort to fight pseudo science, we must be willing and able to defend just such a position and thus what Nietzsche calls the “pathos of distance” must be central to any defense of the modern scientific world.
When science loses its authority, pseudo science thrives. That is the situation we are increasingly in today. There are no objective tests and no clear lines demarcating good and bad science. And that leaves us with the challenge of the modern age: to pursue truth and establish facts without secure or stable foundations. For that, we need reliable guides whom we can trust. And for that reason, you should read Steven Shapin’s latest essay. It is your weekend read.
Golden Dawn, the far-Right fascist party in Greece continues to grow in popularity and violence, according to the Wall Street Journal. Last week the Journal reports:
In a rundown, immigrant-filled neighborhood here, Ilias Panagiotaros, a member of Parliament from Greece's far-right Golden Dawn party, used a megaphone Friday night to exhort an angry crowd to "fight against foreign invaders."
A family watching from a second-floor balcony scrambled for cover as demonstrators hurled bottles and stones at them. "We're going to spill your blood, you Albanian pigs," a man in the flag-waving throng screamed.
Hundreds of protesters marched through the narrow streets—some spraying nationalist graffiti on building facades, others shouting obscene taunts at immigrants. Mr. Panagiotaros, a heavyset man with a shaved head, led them in a resounding chant: "Foreigners out. Greece for the Greeks."
Now this weekend the Washington Post has a follow up (as Walter Russell Mead writes). The Post describes a Greek army surplus store that proudly displays a sticker that carries a favorite party slogan: “Get the Stench out of Greece.” The Post continues:
By “stench,” the Golden Dawn — which won its first-ever seats in the Greek Parliament this spring and whose popularity has soared ever since — means immigrants, broadly defined as anyone not of Greek ancestry. In the country at the epicenter of Europe’s debt crisis, and where poverty and unemployment are spiking, the surplus shop doubles as one of the party’s dozens of new “help bureaus.” Hundreds of calls a day come in from desperate families seeking food, clothing and jobs, all of which the Golden Dawn is endeavoring to provide, with one major caveat: for Greeks only.
Attacks have not stopped at foreigners. One Golden Dawn legislator slapped a left-wing female politician on national television. Party supporters have attempted to shut down performances of progressive theater. Activists see the party’s hand behind three recent beatings of gay men. The Golden Dawn has also begun engaging left-wing anarchy groups in street battles — more evidence, observers say, of a societal breakdown that some here fear could slide into a civil war if Greece is forced out of the euro and into an even deeper crisis.
But perhaps more worrisome, critics say, are signs that the Golden Dawn is establishing itself as an alternative authority in a country crippled by the harsh austerity imposed by its international lenders. It has set up its own “pure” blood bank, providing and accepting donations to and from Greeks only, in a nation of 11 million that is also home to roughly 1.5 million refugees and migrants, many of them from the Middle East, South Asia and Africa. As the party attempts to place a swelling number of unemployed in jobs, its officials say they have persuaded a major restaurant chain to begin replacing immigrants with Greek workers.
The Arendt Center is keeping a close eye on Golden Dawn. The increasing popularity of the party in Greece, which currently polls at over 20% of the Greek population, is a reminder that real economic crises rarely limit themselves to economic upheaval. Many names and words will be bandied about in and with regard to Greece. People will talk about fascism, racism, and totalitarianism. The point is to keep our eyes open to what is happening, which at this point is ugly political nativism along with racialized violence that is gaining enough popular appeal so that it is not being confronted and stopped by legal authorities. It is partly a result of racism, but also a consequence of the utter loss of power and legitimacy on behalf of the Greek elite and the Greek government that has abandoned Greek self-rule to a technocratic European elite. When people feel totally helpless and out of control, as Greeks do today, they will unfortunately seek out scapegoats and victims. The last thing they want to admit is that it is the Greek people themselves and their leaders who are to blame for their predicament.
One key step in any move towards totalitarianism is the erasure of legal citizenship or legal protections for a defined minority. Legal and illegal immigrants are already vulnerable groups even in good times. The danger is that immigrants lose even the basic legal protections and rights that they currently have and, once they do, become superfluous people, the kind of people who simply can be rounded up, imprisoned, expelled, or killed without any legal notice or response—or even according to the law. That of course is not happening in Greece. Let's hope it does not.
At the heart of the task of political foundations and the complex task of reconstruction in postwar scenarios is the question whether such new foundations are possible. Look only at Libya, where this week bandits briefly took control of the Tripoli airport, and we see the difficulty of founding new polities on the ruins of failed dictatorships. The repeated failure to build civil society in many countries only heightens the question: is postwar political foundation in the Middle East possible?
For want of a better example one can always turn to Lebanon: A surprising textbook case of both success and failure in reconstruction, while at the same time the political foundations remain unchanged and the political terms of negotiations have remained more or less unchanged throughout almost an entire century of regional and civil wars. The reconstruction of Beirut has been plagued by fierce criticism as much as by a relatively positive reception in light of the relative order wrought among the hostile parties involved.
While the reconstruction of Beirut is almost a fait accompli and there’s little room for anything but an academic debate, this refers only to the re-making of the historical downtown area around the iconic Martyrs’ Square area in compliance with 1991 National Master Plan by Dar al-Handasah and IAURIF for Solidere.
Here it is crucial to place Solidere’s plans for Beirut in the context of the colonial visions of French planners spanning from 1932 through 1991 and from then to present day.
The Danger Plan (1932) was prepared under the French mandate by a French consulting firm and was the first systematic attempt to lay out an urban plan for the Lebanese capital; followed then by the Ecochard Master Plan (1943, right after independence) that was never mindful of Lebanon’s multi-confessional landscape and failed to account for the possible growth of the city which remained largely unregulated. The General Master Plan (1952) followed and is still considered the only planning strategy established on a legal basis.
Also based upon a French model, the master plan dealt mostly with broadening transportation networks and could hardly envision the expansion of the prosperous years 1958-1967 of the Shihab era during which Beirut experienced agitated expansion. The Plan Directoire Beyrouth et Ses Banlieux (1964) was also orchestrated by Ecochard and tried to limit the city’s expansion – predicting the risk of non-regulation and environmental hazard – but it was never applied. Two later master plans were introduced in 1977 and 1992 but the 1991 directive prevailed.
In this context two particular sites of memory are important in any attempt to re-shape the public spaces of the city in a postwar context; the first being the historical downtown (Martyrs’ Square) that divides the city between East and West and the second no less iconic Beirut Pine Forest (known in Arabic as Horch al-Sanawbar) that divides the city between North and South. The importance of these sites resides in that spite of the failed policy attempts to regulate and integrate them into systematic plans; they were both contested by the population of Beirut as public spaces in the broadest sense: Arenas of inter-confessional interaction.
Previously, I discussed the background of Martyrs’ Square in “Beirut: Reinventing or Destroying the Public Space?” in the context of Hannah Arendt’s ideas on the meaning of the public realm and the world as articulated in The Human Condition, and grounded the problem in the ambiguous legacy of the civil war in Lebanese political historiography and memory. Hereby I shall offer a brief discussion on Beirut Pine Forest and turn the discussion from the persistence of a public world to the question of enacting public spaces.
The Pine Forest originally comprised about 1.25 million square meters (now reduced to 330.000) in the 17th century and its viability as a public space precedes that of Martyrs’ Square (public garden was launched in 1879) as it is known that since the 1840’s the Ottoman rulers kept watch over the forest as a public entity and the Lebanese claimed administrative authority over it, turning it into municipal property around 1878.
The most relevant information on the forest – both historical and in terms of social practices – can be found in Fadi S. Shayya’s paper “Enacting Public Space: History and Social Practices of Beirut Horch al-Sanawbar” (2006). He tells us about the relevance of the forest throughout modern history, mainly derived from the celebration of “Horch el-Eid” during “Eid al-Adha” when large numbers of people gathered in Horch to celebrate the occasion of Muslim pilgrims coming home from Mecca after fasting during Ramadan and after 1840, festivities and activities of recreation, sports and folklore of Beiruti Muslims moved to the park.
During the world wars and long Lebanese civil war the forest was off-limits to the public and it was bombed and burnt out by Israeli jet fighters during the Israeli invasion of Lebanon in 1982. After the end of the civil war around 1995 and in the context of postwar reconstruction the forest was “re-designed” (again in a joint French-Lebanese urban planning venture) and opened to the public, but since then the Municipality of Beirut – rightful owner of the park – has kept the forest off limits to the public and accessible only with special permission.
Different political and bureaucratic issues have arisen around the issue of opening or not opening the forest to the public: At the time of Shayya’s paper (2006) most of the park remained closed and only accessible on certain dates and under certain rules. In 2005 Lebanese daily The Daily Star reported that the forest was withering away after the re-design in absence of a proper team to look after it together with lack of enough security to operate it and five years later, in an extensive report published by NOW Lebanon, it was said that through the forest represents 72% of Beirut’s green space, two thirds of it remain still closed to the public.
It should be noted here that according to official statistics, Beirut has fifty times less greenery than it is recommended by international environmental bodies and recently the American University in Beirut released a scientific study detailing the high levels of pollution in the city. As a part of the reconstruction plans orchestrated in the historical downtown, Solidere is scheduled to open a “Garden of Forgiveness” in the area, but this project comprises a mere 25.000 square meters and is meant to function more as a museum than as a public space that can be contested through interaction by the different communities of the city.
The approach to the reconstruction of Beirut – exemplified both by the historical downtown and the forest – is a critical example of the perverse relationship of Lebanon’s political establishment to both violence and power. In her book Architects Without Frontiers: War, Reconstruction and Responsibility, Esther Charlesworth mentions three major themes that can be learnt from the reconstruction of Beirut as policy failures: Lack of public consultation, apolitical architecture and the preference of process over product.
Aseel Sawalha on the other hand (author of “Reconstructing Beirut: Memory and Space in a Postwar Arab City”) argues forcefully that violence has been a major issue and guiding policy of postwar reconstruction. In his “Healing the Wounds of the War: Placing the War-displaced in Postwar Beirut” (published in the volume “Wounded Cities: Destruction and Reconstruction in a Globalized World”) he discusses at length the “postwar state of emergency” in which the rush of reconstruction created internal displacement out of those who had been already displaced by the war into urban Beirut.
War-displaced residents were offered very modest compensations to move out of their homes in order to make space for the sprawling skyscrapers and luxury apartments on demand, what included also the legendary Valley of the Jews, in which there is a newly renovated synagogue but no Jews. Sawalha says: “Reconstruction means cleaning and organizing disordered spaces, repressing illegality, imposing aesthetic standards on what has become unsightly. As we will see, a lively public discourse on the war-displaced reinforces this enthusiasm for the modern, and the power relations underlying it, in many ways.”
From that time on begins a discourse split between “muhajarin” (displaced victims) and “muhtalin” (opportunistic occupiers) claiming both compensation and usually ruling in favor of the latter. He speaks about the case of an interviewed displaced victim: “Now that there is a legitimate state, we do not have to seek sectarian connections and alliances, he told me. Soon, though, Ali encountered obstacles, leading him to suspect that he had not asked the right people for help. The war time militias and associated mafias, rather than being eclipsed by the state, now operated within it, he concluded.”
Sawalha concludes his paper saying: “According to this article of the Universal Declaration of Human Rights, the Lebanese state and its institutions (the Ministry of the Displaced, the Central Fund for the Displaced), as well as the private developers and the public-private company Solidere, all violated the rights of Beirut’s war-displaced to a decent home, privacy and reputation. In effect they created more displacement, as their projects for reconstruction generated a series of postwar emergencies”.
While this is true for the private citizen, the displacement from the public space – exemplified by both Centre Ville and the Pine Forest – does not exactly help the Lebanese communities of Beirut to engage in a power-sharing argument or discussion that might alleviate the burden of violence. What role does architecture play or can play above the level of policy-making and the question is also begot of whether there is something that architects – in both cases – could have done better to prevent exclusion of the Lebanese from participating in the public space?
The question is purely theoretical. Charlesworth however brings up Foucault to say: “In his seminal essay, ‘Space, knowledge and power’, Michel Foucault engages in this broader debate on the social role of architects: Architecture in itself cannot solve social problems: I think that it can and does provide positive effects when the liberating intentions of the architect coincide with the real practice of people in the exercise of their freedom.”
Charlesworth lays out an interesting hierarchy of categories of roles that architects play in postwar reconstruction as such: Pathologists, Heroes, Historicists, Colonialists, Social Reformers and Educators. Her argument is that different architects, policies and companies exercised all of these roles at different times and in different ways. The facts of reconstruction remain albeit unchallenged; including the fact that the reconstruction of Beirut did bring hope to many people, even if it was a false and transitory hope.
The public space however – and here is where Hannah Arendt continues to be ultimately relevant – cannot be eliminated or weakened without inflicting a deadly blow on human plurality and as such it continues to be constantly contested in Lebanon. In February 2012 it was reported by Green Prophet that Lebanese activists democratically demand access to all of the Pine Forest because it is their inalienable right to public property – not to mention that people from many socially disadvantaged neighborhoods would have access to a public space of interaction with others – and in their demands, they realize the obvious: “Without a politically guaranteed public realm, freedom lacks the worldly space to make its appearance”.

There is probably no question more debated in the course of Middle Eastern uprisings than that of the status of human rights. Anyone familiar with the region knows that the status of human rights in the Middle East is at best obscure. The question of why there was not a “revolution” in Lebanon is a very complex one, tied with the fate of Syria and with the turbulent Lebanese politics since the end of the civil war, and hence cannot be fully answered. In a vague sense it can be said of course that Lebanon is the freest Arab country and that as such it bears a distinctively different character.
While at face value, the statement is true, being “more free than” in the Middle East is simply understating a problem. Just to outline the basic issues, Lebanon’s record on human rights has been a matter of concern for international watchdogs on the following counts:
Security forces arbitrarily detain and torture political opponents and dissidents without charge, different groups (political, criminal, terrorist and often a combination of the three) intimidate civilians throughout the country in which the presence of the state is at best weak, freedom of speech and press is severely limited by the government, Palestinian refugees are systematically discriminated and homosexual intercourse is still considered a crime.
While these issues remain at the level of the state, in society a number of other issues are prominent: Abuse of domestic workers, racism (for example excluding people from color and maids from the beaches) violence against women and homophobia that even included recently a homophobic rant on a newspaper of the prestigious American University in Beirut. The list could go on forever.
The question of gay rights in Lebanon remains somewhat paradoxical. On the one hand, article 534 of the Lebanese Penal Code prohibits explicitly homosexual intercourse since it “contradicts the laws of nature”, and makes it punishable with prison. On the other hand, Beirut – and Lebanon – remains against all odds a safe haven, for centuries, for many people in the Middle East fleeing persecution or looking for a more tolerant lifestyle.
That of course includes gays and lesbians and it is not uncommon to hear of gay parties held from time to time in Beirut’s celebrated clubs. At the same time, enforcement of the law is sporadic and like everything in Lebanon, it might happen and it might not; best is to read the horoscope in the morning and pray for good luck. A few NGO pro-LGBT have been created in the country since the inception of “Hurriyyat Khassa” (Private Liberties) in 2002.
In 2009 Lebanese LGBT-organization Helem launched a ground-breaking report about the legal status of homosexuals in the entire region, in which a Lebanese judge ruled against the use of article 534 to prosecute homosexuals.
It is against the background of this turbulent scenario that Samer Daboul’s film “Out Loud” (2011) came to life, putting together an unusual tale about friendship and love set in postwar Lebanon in which five friends and a girl set on a perilous journey in order to find their place in the world.
Though the plot of the film seems simple, underneath the surface lurks a challenge to the traditional morals and taboos of Lebanese society – homosexuality, the role of women, the troubled past of the war, delinquency, crime, honor – which for Lebanese cinema, on the other hand, marks a turning point.
This wouldn’t be so important in addressing the question of rights and freedoms in Lebanon were it not for a documentary, “Out Loud – The Documentary”, released together with the film that documents in detail the ordeal through which the director, actors and crew had to go through in order to complete this film.
Shot in Zahlé, in mountainous heartland of Lebanon and what the director called “a city and a nation of conservatism and intolerance”, it is widely reported in the documentary that from the very beginning the cast and crew were met with the same angry mobs, insults, and physical injuries that their film in itself so vehemently tried to overcome; a commercial film about family violence, gay lovers, and the boundaries of relationships between men and women. A film not about Lebanon fifteen or twenty years ago, but about Lebanon of here and today.
Daboul writes: “Although I grew up in the city in which “Out Loud” was filmed, even I had no idea how difficult it would be to make a movie in a nation plagued by violence, racism, sexism, corruption and a lack of respect for art and human rights.” The purpose of “Out Loud” of course wasn’t only to make a movie but a school of life, in which the maker, the actors and the audience could all have a peaceful chance to re-examine their own history and future.
Until very recently in lieu of a public space, in Lebanon, any conflict was solved by means of shooting, kidnapping and blackmailing by armed militias spread throughout the country and acting in the name of the nation.
The wounds have been very slow to heal as is no doubt visible from the contemporary political panorama. Recently, a conversation with an addiction counselor in Beirut revealed the alarming statistics of youth mental illness, alcoholism and drug addiction across all social classes in Lebanon, to which I will devote a different article.
Making films in Lebanon is an arduous process that not only does not receive support from the state but is also subject to an enormous censorship bureaucracy that wants to make sure that the content of the films do not run counter to the religious and political sensibilities of the state. In the absence of strong state powers, the regulations are often malleable and rather look after the sensibilities of political blocs and religious leaders rather than state security, if any such exists.
The whole idea of censorship of ideas is intimately intertwined with the reality of freedom and rights and with the severe limitations – both physical and intellectual – placed upon the public space.
In the Middle East, censorship of a gay relationship is an established practice in order to protect public morality; however what we hear on the news daily that goes from theft to murder to kidnap to abuse to rape to racism, does not require much censorship and is usually consumed by the very same public.
If there is one thing here that one can learn from Hannah Arendt about freedom of speech is that as Roger Berkowitz writes in “Hannah Arendt and Human Rights”:
The only truly human rights, for Arendt, are the rights to act and speak in public. The roots for this Arendtian claim are only fully developed five years later with the publication of The Human Condition. Acting and speaking, she argues, are essential attributes of being human. The human right to speak has, since Aristotle defined man as a being with the capacity to speak and think, been seen to be a “general characteristic of the human condition which no tyrant could take away.”
Similarly, the human right to act in public has been at the essence of human being since Aristotle defined man as a political animal who lives, by definition, in a community with others. It is these rights to speak and act –to be effectual and meaningful in a public world – that, when taken away, threaten the humanity of persons.
While these ideas might seem oversimplified and rather vague in a region “thirsty” for politics, they establish a number of crucial distinctions that must be taken into account in any discussion about human rights. Namely:
1) The failure of human rights is a fundamental fact of the modern age
2) There is a distinction between civil rights and human rights, the latter being what people resort to when the former have failed them
3) It is the fact that we appear in public and speak our minds to our fellowmen that ensures that we live our lives in a plurality of opinions and perspectives and the ultimate indicator of a life being lived with dignity.
Even if we have a “right” to a house, to an education and to a citizenship (that is, belonging to a community) if we do not have the right to speak and act in public and express ourselves (as homosexual, woman, dissident and what not) we are not being permitted to become fully human. Regardless of the stability of political institutions, provision of basic needs and security, there is no such a thing as a human world – a human community – in the absence of the possibility of appearing in the world as what we truly are.
“Out Loud” – both the film and the documentary – are a testimony of the degree to which the many elements composing the multi-layered landscape of Lebanese society are at a tremendous risk of worldlessness by being subject to an authority that relies on violence in lieu of power. Power and violence couldn’t be any more opposite.
Hannah Arendt writes in her journals:
Violence is measurable and calculable and, on the other hand, power is imponderable and incalculable. This is what makes power such a terrible force, but it is there precisely that its eminently human character lies. Power always grows in between men, whereas violence can be possessed by one man alone. If power is seized, power itself is destroyed and only violence is left.
It is always the case in dark times that peoples – and also the intellectuals among them – put their entire faith in politics to solve the conflicts that emerge in the absence of plurality and of the right to have rights, but nothing could be more mistaken. Politics cannot save, cannot redeem, cannot change the world. Just like the human community, it is something entirely contingent, fragile and temporary.
That is why no decisions made on the level of government and policies are a replacement for the spontaneity of human action and appearance. It is here that the immense worth of “Out Loud” lies; in enabling a generation that is no longer afraid of hell – for whatever reason – to have a conversation, and it is there where the rehabilitation of the public space is at stake and not in building empty parks to museumficate a troubled past, as has been often the case in Beirut. In an open conversation, people will continue contesting the legacy and appropriating the memory not as a distant past, but as their own.
The case of Lebanon remains precarious: Lebanon’s clergy has recently united in a call for more censorship; and today it was revealed that the security services summon people for interrogation over what they have posted on their Facebook accounts; HRW condemned the performance of homosexuality tests on detainees in Lebanon, even though this sparked a debate and a discussion on the topic ensued at the seminar “Test of Shame” held at Université Saint-Joseph in Beirut and the Lebanese Medical Society held a discussion in which they concluded those tests are of no scientific value.
In a country like Lebanon, plagued by decades of war and violence, as Samer Daboul has said in his film, people are more than often engaged at survival and just at that – surviving from one war to another, from one ruler to another, from one abuse to another, and as such, the responses of society to the challenges of the times are of an entirely secondary order. But what he has done in his films is what we, those who still have a little faith in Lebanon, should have as a principle: “It’s time to live. Not to survive”.
During a conference organized in her honor in Toronto, Hannah Arendt was asked by Hans Morgenthau, to categorize herself as such: “What are you? Are you a conservative? Are you a liberal? Where is your position in the contemporary possibilities?”
Arendt replied: “I don’t know and I’ve never known. And I suppose I never had any such position. You know the left think that I am conservative, and the conservatives think that I am a maverick or God knows what. And I must say I couldn’t care less. I don’t think that the real questions of this century will get any kind of illumination by this kind of thing.”
It is precisely in this spirit that one should read Jens Hanssen’s recent paper “Reading Hannah Arendt in the Middle East: Preliminary Observations on Totalitarianism, Revolution and Dissent”.
Hanssen offers in his paper a rather detailed survey of how Arendt has been read – and misread – by the Middle East, beginning with Kanan Makiya’s World Policy Journal article (2006) “An Iraqi Discovers Arendt”, all the way to Israeli revisionist (and evidently critical of Israel) scholars such as Idith Zertal and Amnon Raz-Krakotzkin.
The particular examples he brings up are paradigmatic of this already established tradition of appropriations of Hannah Arendt that though emerging from her political thought, have much to do with politics and little with thinking.
For example, the case of Kanan Makiya is interesting if only because of his controversial – and rather maverick – position in the landscape of Iraqi politics. This Marxist engineer-turned-neo-conservative political advisor (in Hanssen's telling) is apparently credited with being the first Arab author to apply Arendt’s phenomenology of totalitarianism to Baathist Iraq.
Makiya makes a case for Iraq as a totalitarian regime in Arendt’s terms, drawing a straight line from anti-Semitism and intellectual support for Saddam Hussein to comparisons with Nazi Germany. Though his book The Republic of Fear stands for many Iraqis as the greatest testimony to the sad state of affairs under Hussein, the analysis is at best a misappropriation in many respects and seems to fall within the line of warmongering that Arendt so vehemently criticized as McCarthyism: To use totalitarian means to fight – real or imagined – totalitarian enemies.
The most interesting reading he brings up however is Vince Dolan’s course at the American University in Beirut, “Contemporary Philosophical Reflections on the Use of Political Violence”, in the spring of 1983. Dolan tailored the course to polemicize Arendt’s distinction between power and violence – perhaps the most difficult in all of her thought – by first exposing students to Habermas’ evaluation of Arendt’s project and then bringing her into conversation with Popper, Adorno and Horkheimer.
While this practice is common among liberal academics, the integration of Arendt into the corpus of critical theory has been time and again debunked by serious Arendt scholars, of which I might bring only two salient examples:
First, Dana Villa (Arendt and Heidegger, 1996, p. 3-4) argues that although Habermas called Arendt’s theory of political action “the systematic renewal of the Aristotelian concept of praxis”, there is no one that would argue more vehemently against Aristotle (and the whole project of critical theory) than Arendt.
According to Villa, critical theory has immensely profited from Arendt’s renewal of Aristotelian praxis as opposed to the instrumentalization of action in order to highlight the intersubjective nature of political action, when in fact this renewal is a radical reconceptualization whose renewal is nothing but a renewal in order to overcome rather than to restore the tradition of political thought of and since Aristotle.
Second, Fina Birulés insisted in an interview from 2001 that there is a wide gap between Arendt’s radical theory of democracy and Habermas. According to Birulés, though Habermas is deeply indebted to Arendt, his theory of communicative action is hardly political at all and he reduces the concept of plurality to some sort of ideal community of dialogue.
Doubtless Hanssen is correct in pointing out that Arendt did not provide a concise definition of totalitarianism. Definition is a privilege of theory that Arendt’s story-telling didn’t embrace and she “merely” listed phenomenological elements. However he also indicates how Arendt insisted that only two forms of totalitarianism existed: Nazi Germany and the Soviet Union. This distinction is crucial to understand the rest of his paper.
Nowadays totalitarianism – as much as the banality of evil – is a slogan in newspapers and politics, often lacking in meaning and intention and this brings to mind the whole post 9-11 discourse in philosophy and politics in which Islam and Islamism – among other things – take the place of the “old” totalitarian movements.
While it is true that in phenomenological and structural terms nothing since the collapse of the Soviet Union can be called strictly totalitarian, there is no doubt that there are totalitarian elements in many movements and policies not only in the Middle East today, but also in the democratic West.
Among other – far less influential readings of Arendt – Hanssen lists the translations into Arabic and Persian, providing crucial information about how and why Arendt informed certain – mostly – Arab authors.
Lastly there is an elaborate discussion on the use – and again, abuse – of Arendt by Israeli scholars since her “rehabilitation” in Israel that coincided with the rise to prominence of certain revisionist scholars.
Though Hannah Arendt wasn’t exclusively concerned with Zionism or the Jewish question, it is undeniable that her entire work was informed by her status and experience as a Jew in the Europe of the early 20th century.
There are many Hannah Arendts and to this effect Jerome Kohn writes in the introduction to her “Jewish Writings”: “In 1975, the year she died, she spoke of a voice that comes from behind the masks she wears to suit the occasions and the various roles that world offers her. That voice is identical to none of the masks, but she hopes it is identifiable, sounding through all of them”.
Something that is identifiable in her entire work – but not identical anywhere, is her concern with the young State of Israel in spite of the controversies into which she became trapped later on.
While it is true that Arendt was very critical of the Zionist establishment and of the course that Israel had taken, it is also important to remember that her writings (“The Crisis of Zionism” and “Peace or Armistice in the Middle East”) were anchored in an intense anxiety over the Jewish people regaining control of their own destinies and entering the realm of politics.
Julia Kristeva expressed this best in her speech upon receiving the Hannah Arendt Prize in 2006, making it clear how for Arendt the survival of Israel and the refoundation of politics in the West was part of one and the same task:
Thirty years after her death, added to the danger she tries to confront through a refoundation of political authority and which, as they get worse, make this refoundation increasingly improbable, is the new threat that weighs on Israel and the world. Arendt had a premonition about it as she warned against underestimating the Arab world and, while giving the State of Israel her unconditional support as the only remedy to the acosmism of the Jewish people, and as a way to return to the “world” and “politics” of which history has deprived, she also voiced criticism.
But Jerome Kohn writes also in the introduction to the Jewish Writings, “Already in 1948 Arendt foresaw what now perhaps has come to pass, that Israel would become a militaristic state behind closed but threatened borders, a “semi-sovereign” state from which Jewish culture would gradually vanish” (paraphrased from her “To Save the Jewish homeland”).
In her piece “Peace or Armistice in the Middle East,” Arendt laid out what is in my opinion a foundation for what could be the ideal of Arab-Jewish cooperation in the Middle East – including even a surprisingly rare background on Arab personalities that had lent support to the possibility of a Jewish settlement from Lebanon and Egypt – but the element of religious fundamentalism and anti-Semitism that have crystallized now in the Middle East couldn’t be foreseen by Arendt, or at least not to the extent that they were articulated by Kristeva:
Although many of her analyses and advances seem to us more prophetic than ever, Arendt could not foresee the rise of Islamic fundamentalism, nor the havoc it is wreaking in a world faced with the powerlessness of politics to respond, and the apolitia, the indifference created by the omnipresent society of the spectacle.
Hanssen concludes from reading Arendt on totalitarianism, revolution and dissent in the Middle East that “one of the most powerful (in Arendt’s sense of power as consent-based), non-violent movements coming out of the Arab World today is the Boycott, Sanctions and Divestments campaign that Palestinian civil society groups have called for in 2005 and has now become a global counter-hegemonic phenomenon” and raises the question whether Hannah Arendt would have supported Palestinian BDS movement to bring about the end of Israeli occupation.
On the one hand he argues that “the intellectual merit of BDS campaign from an Arendtian standpoint is that it is not based on old and invalid hyperbolic equation of Israel with Nazi Germany.” On the other hand, he also says:
There is certainly ample room for this kind of non-violent action in her writings. For one, she supported the economic boycott of German businesses in the 1930’s and was furious when Zionist Organization in Palestine broke it.
Leaving the associations with Nazi Germany asides, it is vital to recall that it was Arendt who said that not even in the moon is one safe from anti-Semitism and that the State of Israel alone wouldn’t come to solve the Jewish question.
It is clear by now that BDS campaign has blended elements no doubt altruistic of non-violent struggle with elements from the old anti-Semitism, in which there’s little distinction made between Israelis and Jews.
BDS has come to include not only boycott to the settlements (as has been articulated with great intelligence by Peter Beinart and his book “The Crisis of Zionism”) but also academic and cultural boycott. In extreme cases, there have been boycotts of products not for being Israeli or produced in the settlements, but merely out of being kosher products produced in Britain and the United States.
While it is more than clear that Arendt saw and foresaw the risks and dangers to which Israel polity was exposed by its leaders, she also articulated with clarity that it wasn’t the Jews alone who were responsible for this sad state of affairs and whether or not Hannah Arendt’s ideal of a binational state is at all realizable at this point – bearing in mind the complexities of Arab Spring – what is clear is that an ideology fed on old anti-Semitism and prejudice as much as on uncritical views of Arab and Palestinian history is very unlikely to produce the Arab-Jewish councils (at the heart of her theorizing on revolutions) upon the basis of which a secular and democratic state might be founded.
The Constitutional Council, France’s highest court, will soon issue a ruling with significant implications for how we think about free speech, violence, and collective memory. The ruling, due by the end of February, will determine whether French lawmakers can criminalize the denial of the Armenian genocide in the Ottoman Empire during World War I.
Legislation to this effect passed the French National Assembly in December 2011 and the Senate just last month, but the Council agreed to rule on the constitutionality of the provision after inquiries from dozens of parliamentarians. President Nicolas Sarkozy has indicated that he will sign the bill into law if and when it reaches his desk, but he cannot do so until the court announces its decision. The geopolitical implications of this ruling are potentially far-reaching, for it may decisively shape Turkey’s relationship with the European Union and other states in the Middle East. But the ruling’s cultural and philosophical ramifications are significant as well, for they raise important questions about public discourse and collective memory not simply within but also across national boundaries.
The bill that would criminalize Armenian genocide denial was introduced in the National Assembly by Valérie Boyer, a parliamentarian from Marseilles who is affiliated, like Sarkozy, with the center-right Union for a Popular Movement. It would require a year in jail and a fine of 45,000 Euros (approximately $59,000) for “those who have praised, denied, or roughly and publicly downplayed genocidal crimes, crimes against humanity, and war crimes.” Significantly, the legislation does not specifically mention the mass killings of Armenians, but the only other instance of genocide recognized by the French government is the Holocaust, and its denial is already defined as a criminal act under another law. Despite the bill’s generic formulation, then, its effective point of reference is rather targeted.
Members of the French opposition have charged that the bill constitutes a cynical effort to curry favor with the country’s sizable Armenian population in advance of this spring’s presidential elections. Foreign Minister Alain Juppé, meanwhile, has opposed the legislation because he believes it will hinder efforts to maintain Turkish cooperation on urgent matters of state, including Iran’s nuclear ambitions and the ongoing government crackdown in Syria.
But the bill’s proponents deny that they have any ulterior motives in either the national or international arena: Boyer insists that genocide is a general human concern that stands “over and above politics,” while Sarkozy asserts that the bill is in “no way aimed at any state or people in particular.” In this respect, the legislation and its overt rationale are consistent with an important strand of the French republican tradition, one that equates the nation and polity with a commitment to universal principles.
Given the state’s ideological position, it should come as no surprise that Turkish responses to the legislation have been hostile. The national government, led by the center-right Justice and Development Party, has suspended many of Turkey’s diplomatic, economic, and military relations with France, and Prime Minister Recep Tayyip Erdoğan has dismissed the bill as an instance of “evident discrimination, racism, and massacre of free speech.” In addition, Erdoğan has accused France of its own unacknowledged genocide during the era of colonial rule in Algeria, while other lawmakers have insisted that France has failed to confront its unseemly role in the 1994 genocide in Rwanda. Far from regarding the legislation as a universalist condemnation of genocide and genocide denial, then, Turkish state officials have treated it as a direct attack on their national self-regard, and they have been quick to accuse the French government of a pernicious double standard: Sarkozy and his colleagues want Turkey to reckon with its burdened past when France has not scrutinized its own violent (post)colonial history.
On the one hand, I sympathize with the bill’s impulse to engage with past instances of violence. Remembrance of traumatic pasts is not a zero-sum game: attention to one instance of collective violence, such as the murder, deportation, and starvation of Armenians in the Ottoman Empire, does not prevent or preclude attention to others, such as the assault, torture, and killing that accompanied French colonial domination in Algeria. In fact, as Michael Rothberg suggests, the remembrance of past violence across national and/or imperial contexts “has the potential to create new forms of solidarity and new visions of justice.”
On the other hand, I am uncomfortable with the premise that certain forms of public discourse, even those associated with the denial of genocide, should be prohibited by law. I am too committed to liberal thinking to believe that this kind of restriction on free public speech is acceptable, and I have my doubts that it will actually encourage a reasoned understanding—and condemnation—of collective violence in the past, present, and future.
In particular, I am very concerned that this legislation, if it indeed becomes law, will have a chilling effect on ongoing discussion and debate in Turkey.
Turkish state and public institutions have grown a bit more receptive to Kurdish grievances over the past decade, and in November 2011 Prime Minister Erdoğan took the remarkable step of apologizing for army and air force attacks that killed nearly 14,000 Kurds in Dersim (now known as Tunceli) from 1936 to 1939. To be sure, Erdoğan issued this apology as police and military personnel were detaining hundreds if not thousands of Kurdish activists in the state’s renewed counterinsurgency campaign. But we should not neglect the fact that such a pronouncement would have been unthinkable only a few years ago. How ready will Erdoğan’s government be to acknowledge other elements of Turkey’s fraught past if France criminalizes denial of the Armenian genocide? Not very, I suspect.
In the end, then, I support concerted public engagement with the nature and extent of the Armenian genocide in France, Turkey, and elsewhere. Precisely for this reason, however, I also oppose the criminalization of Armenian genocide denial.
